Councilmember Brandes left the room at this time. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> No one in the audience spoke in favor of or in opposition to the <br />application. <br /> <br /> Mayor Mercer declared the public hearing closed. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wil- <br />son, that Ordinance No. 1354, after finding that the amendment to the <br />Municipal Code is consistent with the General Plan and with the purposes of <br />the Health and Safety Ordinance and Zoning Ordinance; approval RZ-87-10, ap- <br />plication of the City of Pleasanton to amend the Municipal Code to establish <br />regulations and procedures pertaining to recycling facilities and related mat- <br />ter in the Industrial and Commercial zoning districts, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Brandes <br /> <br /> Councilmember Brandes reentered the room at this time. <br /> <br />RZ-87-13~ Application of the City of Pleasanton to prezone an approximately 63 <br />acre site from the "A" {Agricultural) District to the PUD (Planned Unit <br />Development)-Low Density Residential/Rural Density Residential/Public Health <br />and Safety District located on the south side of Old Dublin Canyon Road ap- <br />proximately 4~800 feet west of the intersection of Foothill Road and Old Dub- <br />lin Canyon Road <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 88:44) dated February 2, 1988, regard- <br />ing this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Brad Hirst, 6280 West Las Positas, asked for support of the applica- <br />tion. He advised the project has been revised in accordance with the concerns <br />of LAFCO. He stated that 15 houses are proposed on the 63 acres. <br /> <br /> Mrs. Margaret Tracy, representing Preserve Area Ridgelands Committee, <br />stated this property is under the Williamson Act, which will remain for an- <br />other eight years. Any development of the property would be in violation of <br />the Williamson Act. She felt an Environmental Impact Report should be re- <br />quired on this application; a negative declaration is not adequate to address <br />where there are heritage trees and unstable soils. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember butler, and seconded by Councilmember Bran- <br />des, that Resolution No. 88-57, determining on the basis of a review of ini- <br />tial environmental study done for this project, that no significant environ- <br />mental impact would occur as outlined in the City's guidelines and that a <br />negative declaration is appropriate in connection with RZ-87-13, application <br /> <br /> - 10 2-2-88 <br /> <br /> <br />
