It was moved by Councilmember Butler, and seconded by Councilmember Wil- son, that Ordinance No. 1354, after finding that the amendment to the Municipal Code is consistent with the General Plan and with the purposes of the Health and Safety Ordinance and Zoning Ordinance; approval RZ-87-10, ap- plication of the City of Pleasanton to amend the Municipal Code to establish regulations and procedures pertaining to recycling facilities and related mat- ter in the Industrial and Commercial zoning districts, be introduced. RZ-87-13~ Application of the City of Pleasanton to prezone an approximately 63 acre site from the "A" {Agricultural) District to the PUD (Planned Unit Development)-Low Density Residential/Rural Density Residential/Public Health and Safety District located on the south side of Old Dublin Canyon Road ap- proximately 4~800 feet west of the intersection of Foothill Road and Old Dub- lin Canyon Road Consider Adoption of Negative Declaration Mr. Swift presented his report (SR 88:44) dated February 2, 1988, regard- ing this matter. Mayor Mercer declared the public hearing open on the application and the negative declaration. Mr. Brad Hirst, 6280 West Las Positas, asked for support of the applica- tion. He advised the project has been revised in accordance with the concerns of LAFCO. He stated that 15 houses are proposed on the 63 acres. Mrs. Margaret Tracy, representing Preserve Area Ridgelands Committee, stated this property is under the Williamson Act, which will remain for an- other eight years. Any development of the property would be in violation of the Williamson Act. She felt an Environmental Impact Report should be re- quired on this application; a negative declaration is not adequate to address where there are heritage trees and unstable soils. There being no further testimony, Mayor Mercer declared the public hearing closed on the application and the negative declaration. It was moved by Councilmember butler, and seconded by Councilmember Bran- des, that Resolution No. 88-57, determining on the basis of a review of ini- tial environmental study done for this project, that no significant environ- mental impact would occur as outlined in the City's guidelines and that a negative declaration is appropriate in connection with RZ-87-13, application - 10 2-2-88
