of the City of Pleasanton to prezone an approximately 63 acre site from the <br />"A" (Agricultural) District to the PUD (Planned Unit Development)-Low Density <br />Residential/Rural Density Residential/Public Health and Safety District lo- <br />cated on the south side of Old Dublin Canyon Road approximately 4,800 feet <br />west of the intersection of Foothill Road and Old Dublin Canyon Road, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by <br />Councilmember Wilson, that Ordinance No. 1355, to be read by title only and <br />waiving further reading thereof, approving RZ-87-13, application of the City <br />of Pleasanton to prezone an approximately 63 acre site from the "A" (Agricul- <br />tural) District to the PUD (Planned Unit Development)-Low Density Residential/ <br />Rural Density Residential/Public Health and Safety District located on the <br />south side of Old Dublin Canyon Road approximately 4,800 feet west of the <br />intersection of Foothill Road and Old Dublin Canyon Road, with a condition <br />that the property be restricted to those uses consistent with the Williamson <br />Act (namely the uses allowed within the "A" Agricultural District) until such <br />time as the current agricultural contract expires or is cancelled, be <br />introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Resolutions Making Application to LAFCO and Agreeing to the Exchange of Prop- <br />erty Tax Revenue and Initiating Prezoning for Annexation No. 120 (Harris) <br />(Contd. Open from 1-19-88) <br /> Councilmember Mohr abstained from participation in this item because of <br />Conflict of Interest. <br /> <br /> Mr. Elliott presented his report (SR 88:55) dated February 2, 1988, <br />regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Mike Harris, 6111 Johnson Drive, representing Country Investors, <br />stated he concurs with the staff report. He advised he has been working with <br />staff and Mr. Ward for some time to get this matter resolved, and directed by <br />Council last October. Mr. Harris stated he had met with City staff and Mr. <br />Ward on Monday in a last attempt to work out a solution but nothing was re- <br />solved. He advised he has offered to buy the property at 105% of market value <br />or trade some of his land to replace Mr. Ward's land. He will also guarantee <br />ingress and egress to the property. Mr. Ward feels that a record of survey <br />needs to be done and the submittal of a preliminary plan before he can decide. <br />Mr. Harris stated he is willing to start the record of survey. He urged Coun- <br />cil to start the annexation process; Mr. Ward's property rights will remain in <br />tact. <br /> <br /> Mr. George Ward, 4941S.W. 26th Drive, Portland, Oregon, property owner of <br />the parcel involved, stated this property has been subjected to abuse since it <br />was owned by Dr. Porter, his father-in-law.
