basis of a review of initial environmental study done for this <br />project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration <br />is appropriate in connection with the application of Amador <br />Savings/Beratlis to subdivide an approximately 30 acre site into <br />64 residential lots located on the north side of Crellin Road at <br />the intersection of Zinfandel Court and Malaga Court, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Wilson <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Butler and Mayor Mercer <br /> <br /> It was moved by Councilmember Brandes, and seconded by Coun- <br />cilmember Wilson, that Resolution No. 88-29, approval the appeal <br />and the application of Amador Savings/Beratlis to subdivide an <br />approximately 30 acre site into 64 residential lots located on <br />the north side of Crellin Road at the intersection of Zinfandel <br />Court and Malaga Court, subject to conditions contained in At- <br />tachment A of Staff Report 88:25, amending Condition 7 to include <br />Lots 1-14, and adding a condition that grading and remainder of <br />housing construction be prohibited on Sundays and holidays, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Wilson <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Butler and Mayor Mercer <br /> <br /> Mayor Mercer took over Chairing the meeting at this point. <br /> <br />PUD-81-30-41D, Application of Lyon's Restaurant for design review <br />approval to construct an approximately 4,774 sq. ft. restaurant <br />and related improvements on an approximately 0.27 acre site <br />within Gateway Square, an approved commercial center located at <br />4889 Hopyard Road. Zoning for the property is PUD (Planned Unit <br />Development)-Commercial, Industrial, and Offices District <br />(Contd. Open from 12-1-87) <br /> Mr. Swift presented his report (SR 88:32) dated January 19, <br />1988, regarding this matter. <br /> <br /> Mayor Mercer declared the continued public hearing open on <br />this item. <br /> <br /> Mr. Marvin Alldaffer, Vice President of Lyon's Restaurant, <br />stated the conditions of approval are acceptable. He added that <br />the building is compatible with the surrounding building. <br /> <br /> No one in the audience spoke in opposition to the item. <br /> <br /> There being no further testimony, Mayor Mercer declared the <br />public hearing closed on this application. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Coun- <br />cilmember Mohr, that Resolution No. 88-30, approval of PUD-81-30- <br />41D, application of Lyon's Restaurant for design review approval <br /> <br /> - 7 - 1-19-88 <br /> <br /> <br />
