He stated that the sale of alcohol and the hours of operation <br />were a legitimate concern, and that Council had made changes to <br />these two matters. He stated that without the mini-mart this <br />proposal makes good sense. <br /> <br /> Councilmember Brandes stated that with the many mitigation <br />measures placed on this facility he felt the project is an ap- <br />propriate use and will be an asset in the neighborhood. <br /> <br /> Councilmember Mohr stated she felt that residents in the area <br />should be allowed to review the proposed changes. She stated <br />there is still a concern about the mini-mart. <br /> <br /> Mayor Mercer complimented Councilmembers Wilson and Brandes <br />for the time they spent with the developers and neighbors. He <br />stated he has not changed his opinion on this matter. Back in <br />1981 everyone voted not to have a gas station, car wash and mini- <br />mart at this location and he did not see any reason to change <br />that opinion now. He stated there is no demand for a gas station <br />with mini-mart on that corner, and he felt the citizens felt the <br />same. He stated Planning Commission does not support the proj- <br />ect. He felt a more appropriate use should be considered at this <br />location, which is one of the entrances to the City. <br /> <br /> It was moved by Councilmember Wilson, and seconded by Coun- <br />cilmember Butler, that Ordinance No. 1349, approval of PUD-80-15- <br />5D, application of Tioga Construction Company to rezone an ap- <br />proximately 3.63 acre site to PUD (Planned Unit Development)- <br />Commercial District to accommodate automobile wash, service sta- <br />tion, food mart, restaurant and retail uses as permitted uses, <br />and to approve a development plan for an approximately 30,142 sq. <br />ft. mixed use commercial complex located at the southeast corner <br />of Santa Rita Road and Pimlico Drive, but eliminating the mini- <br />mart and adding a snack stand in the pump island, and requiring <br />that construction of the retail commercial building be started <br />before operation of the service station, be re-introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Wilson <br />NOES: Mayor Mercer <br />ABSENT: None <br /> <br /> Mayor Mercer advised that this matter will be considered by <br />the Planning Commission at their meeting of January 27, 1988, and <br />will be considered by Council for adoption of the ordinance on <br />February 2, 1988. <br /> <br />Remove Standby Councilmember Position from Code <br /> Mr. MacDonald presented his report (SR 88:17) dated January <br />19, 1988, regarding this matter. <br /> <br /> It was moved by Councilmember Butler, and seconded by Coun- <br />cilmember Brandes, that Ordinance No. 1352, to be read by title <br />only and waiving further reading thereof, to repeal Pleasanton <br />Municipal Code Sections 2.04.020 and 2.04.030 concerning the cre- <br />ation of standby councilmembers, be introduced. <br />The roll call vote was as follows: <br /> <br /> - 13 - 1-19-88 <br /> <br /> <br />
