Council concurred.

CITY COUNCIL COMMITTEE REPORTS
There were no City Council Committee Reports presented at this meeting.

MEETING OPEN TO THE PUBLIC
Mr. Jim Liu, 3625 Kamp Drive, stated the residents in the Mohr-Martin area
have formed a homeowners association Gardens of Mohr Park. He advised that
residents from this area are present tonight to support the proposed park to
be considered by Council. He asked those in the audience to stand who are
present on this item - approximately 30 people stood.

Mrs. Yvonne Crutch, 818 Sylvaner Drive, representing Vintage Hills II,
stated that approximately 12 people are present tonight who are concerned and
disturbed about the grading in the Amador Valley Savings and Loan project be-
hind their homes. They feel it is not being done according to what Council
and the residents thought was approved. She stated that even with a six foot
fence she will be looking up at a foundation. She felt this is an infringe-
ment on her privacy. She urged Councilmembers to come out to the site to look
at the grading and elevation.

Given the previous draw of Councilmembers who could participate in approv-
als relating to this Amador Valley Savings and Loan project because of con-
flict of interest, Mayor Mercer and Councilmember Butler abstained from par-
ticipation in this discussion.

Councilmember Brandes asked if staff has inspected the grading. Mr. E1-
liott stated he has inspected the grading, which is nearly complete, and it is
within six inches of the approved plan.

Councilmember Wilson questioned other members if the grading is done in
accordance with plans approved by the Council, is Council going to reconsider
its action.

Councilmember Mohr stated that Council, staff, and the neighbors need to
get together to see what is happening.

Councilmember Brandes felt that further permits should not be issued until
the grading issue has been settled.

Mr. Howard Watenmaker, 812 Sylvaner Drive, stated it was his understanding
that the houses in the project would not impact existing homes; now he is
looking at dirt and the bottom of homes. He stated the grading is unaccept-
able. He added that the sewer pipes are not being located according to what
the residents thought they would be located. Mr. Elliott stated the sewer and
storm drain pipes need to be kept as low as possible.

Councilmember Wilson asked is more dirt could be moved without hauling it
out on city streets. Mr. Elliott stated he would be reluctant to say how much
more dirt could be moved.

7 - 7-5-88
