Mayor Mercer declared the public hearing closed. <br /> <br /> Councilmember Brandes stated that as a member of the Council Committee to <br /> study the garbage rate increase, many hours were spent reviewing this matter. <br /> In light of the fact that the Garbage Company has not increased their rates in <br /> seven years he felt the rate increases are fair. <br /> <br /> Mayor Mercer stated that when the garbage franchse agreement comes back <br />for approval he would like to see included a clause which would provide a <br />first right of refusal to the City to buy the franchise, because of what is <br />going on now in the solid waste industry. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 88-326, approve the request of Pleasanton Garbage <br />Service, Inc., establishing fixed and uniform refuse collection rates for the <br />City of Pleasanton (increase of 20%), effective April 1, 1988, and that this <br />approval be conditioned upon Pleasanton Garbage Service agreeing to meet with <br />the City to prepare a new franchise agreement. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Mohr <br /> <br />MATTERS CONTINUED FOR DECISION <br />item lOa <br />Adoption of Ordinance No. 1366, Modifying the Growth Manaqement Proqram to <br />Permit the School District to obtain growth management approval on lands with- <br />out PUD approval <br />(Intro. 6-21-88~ 4-Ayes~ 1-No} <br /> Mayor Mercer stated that Ordinance No. 1366 was introduced June 21, 1988, <br />by a vote of 4-Ayes, 1-No, and that it was now in order to adopt the <br />ordinance. <br /> <br /> Councilmember Brandes stated that even through he voted No on this or- <br />dinance he is concerned whether or not this is talking about a specific piece <br />of property; the ordinance does not state that. <br /> <br /> Mayor Mercer stated he has the same concern; the ordinance should refer to <br />the specific piece of property owned by the City <br /> <br /> After further discussion, it was moved by Mayor Mercer, and seconded by <br />Councilmember Butler, that Ordinance No. 1366, modifying the Growth Management <br />Program to permit the School District to obtain growth management approval on <br />a city-owned parcel of land without PUD approval, be re-introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: None <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no reports of Boards and Commissions presented at this meeting. <br /> <br />REPORTS OF THE CITY MANAGER <br />item 12a <br />Consideration of a Request from Pleasanton Garbage, Inc., to Increase Rates <br /> <br /> - 13 7-5-88 <br /> <br /> <br />
