Councilmember Mohr asked about the time line of the road improvements. <br />Mr. Cohen stated it is not definite as to when construction will actually <br />start and it is his understanding that the line that goes through his property <br />has not been established yet. He stated he is willing to take the risk and <br />waive his rights to reimbursement for improvements. <br /> <br /> Mayor Mercer stated that when property owners on Vervais Avenue asked <br />about making improvements to their property that was to later become the Del <br />Valle Parkway, the City Attorney advised that if they made the improvements <br />the City would have to pay the increased appraised price for the property. He <br />asked if the City would be required to pay the value of the property. Mr. <br />Beougher stated that these improvements are different. The owner has statedhe <br />will waive any reimbursement for improvements. The City may not be required <br />to pay for these improvements given owner's waiving reimbursement, but further <br />research on this point would be needed. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, <br />that Resolution No. 88-323, denying the appeal of the City Council, and ap- <br />proving Case Z-88-149, the application of McDonald's Corporation for design <br />review approval to construct a tandem drive-through window addition to an ex- <br />isting restaurant located at 6800 Santa Rita Road, subject to conditions con- <br />tained in the staff report dated May 25, 1988, and adding a condition that <br />theapplicant waives the inclusion of the appraised value of the drive-through <br />window and associated improvements in any condemnation initiated by the City <br />for the McDonald's facility relative to the rerouting of the Santa Rita Road/ <br />1-580 interchange, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />item 9e <br />AP-88-13~ Appeal by Clyde Vaughn of a decision of the Board of Adjustment <br />denying Case V-88-12, application for a variance from the Municipal Code to <br />allow for the installation of wall-mounted signs on the second floor of an <br />existing office/commercial building where such signage is not permitted to be <br />located at 400 Main Street.
