19 <br /> <br /> Mr. Swift presented his report (SR 88:304) dated July 5, 1988, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on thie item. <br /> <br /> Mr. David Jones, representing the applicant, stated the first request came <br />in 1982, which was a petition for PUD zoning with the intent of breaking the <br />acreage into lots. He stated that several developers expressed interest in <br />the property but did not follow through so the owners have decided to proceed <br />with their own development. He advised they want to retain the rural atmo- <br />sphere and did not want sidewalks and parking lanes to spoil it. He stated he <br />is agreeable to the conditions. <br /> <br /> No one in the audience spoke in opposition to the application. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> After discussion, it was moved by Councilmember Wilson, and seconded by <br />Councilmember Mohr, that Ordinance No. 1373, to be read by title only and <br />waiving further reading thereof, and finding that the development plan is con- <br />sistent with the PUD Ordinance and General Plan, approve PUD-88-8, application <br />of Ernest and Charlotte Jones for development plan approval for a three-lot <br />single family residential development to be located at 1605 Rose Avenue, sub- <br />ject to conditions listed on Attachment A of Staff Report 88:304, be <br />introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />item 9d <br />AP-88-12~ Appeal by the City Council of a decision of the Design Review Board <br />which approved Case Z-88-149, the application of McDonald's Corporation for <br />design review approval to construct a tandem drive-throuqh window addition to <br />an existing restaurant located at 6800 Santa Rita Road. Zoning for the prop- <br />erty is CF (Freeway CommercialI District <br /> Mr. Swift presented his report (SR 88:316) dated July 5, 1988, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the item. <br /> <br /> Mr. Jack Cohen, representing the applicant, stated they applied for this <br />addition two years ago to enhance the efficiency of their business. He under- <br />stand that they will have to relocate when the Santa Rita/I-580 interchange is <br />underway. He is not sure when construction will take place and is willing to <br />go ahead and construct under these circumstances. <br /> <br /> Councilmember Brandes stated he asked to have this appealed because of his <br />concern that this expenditure of money is not something that the City or the <br />assessment district will have to pay for in the relocation of McDonalds. He <br />stated if there is a mechanism to do that then his concerns are satisfied. <br /> <br /> Mr. Cohen stated he would not expect the City to pay for this addition <br />twice; he would not expect any reimbursement for this extra expense. <br /> <br /> - 10 7-5-88 <br /> <br /> <br />
