417 <br /> <br />NOES: None <br />ABSENT: Councilmember Wilson <br /> <br />item 9d <br />AP-88-10~ Appeal by the City Council of Design Review Board action approving <br />application of Terry O'Connor~ Z-88-147~ for design review approval to modify <br />an existing residential structure for office uses and to construct a three- <br />story, four unit apartment complex at the rear of an approximately 6~475 sq. <br />ft. site located at 148 Spring Street. Zoning for the property is CC (Central <br />Commercial) District <br /> Mr. Swift presented his report {SR 88:260) dated June 7, 1988, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the item. <br /> <br /> Mr. Terry O~Connor, applicant, stated he would answer any questions by <br />Council; he did not know what else he could do with the proposed plan. <br /> <br /> Councilmember Mohr stated that Council has received several letters from <br />neighbors in opposition to this application; she asked Mr. O'Connor if he had <br />met with them to inform them of the project. Mr. O*Connor stated he had not <br />met with the neighbors. <br /> <br /> Mayor Mercer stated he appealed the application because of his concerns <br />relative to a three-story building in the downtown. Mr. O'Connor stated he <br />has excavated the lower floor so that the building will be only 23 feet high <br />from the street, which meets the two-story codes. Mr. Swift advised that it <br />would be slightly lower than the Goldsworthy building across the street, from <br />the street level. Mayor Mercer stated he felt this parcel would be more ap- <br />propriate for commercial and offices; not residential. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on this item. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 88-257, approving AP-88-10, appeal by the City Coun- <br />cil of Design Review Board action approving application of Terry O*Connor, and <br />denying Zo88-147, for design review approval to modify an existing residential <br />structure for office uses and to contruct a three-story, four unit apartment <br />complex at the rear of an approximately 6,475 sq. ft. site located at 148 <br />Spring Street, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wilson <br /> <br />item 9e <br />AP-88-11, Appeal by the City Council of Planning Commission action approving <br />application of Hacienda Business Park Owners Association~ UP-88-14, for a con- <br />ditional use permit to operate a park-and-ride lot facility to be located on a <br />portion of an approximately 2.3 acre site located at the southeast corner of <br />the intersection of Chabot Drive and Owens Drive.
