407 <br /> <br />NOES: None <br />ABSENT: Councilmember Wilson <br /> <br /> Ms. Dorothy Bevard, 7974 Hillsboro Court, thanked Council and staff for <br />approving this project. <br /> <br />item 12c <br />Condieration of Proposed Aqreement Clarifyinq the Valley Memorial Hospital <br />Exemption from the North Pleasanton Improvement District <br /> Mr. MacDonald presented his report (SR 88:241) dated June 7, 1988, regard- <br />ing this matter. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 88-262, approving an amendment to the July 2, 1985 <br />Agreement exempting Valley Memorial Hospital from the North Pleasanton Im- <br />provement District projects, as set forth in Staff Report 88:241, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wilson <br /> <br />item 12d <br />Request by Ralph Romero to remove Trees on Property within PUD 87-25 <br /> Mr. Swift presented his report (SR 88:239) dated June 7, 1988, regarding <br />this matter. <br /> <br /> Councilmember Mohr abstained from participation in the item because of <br />Conflict of Interest. <br /> <br /> Mr. Ralph Romero, 2810 Foothill Road, requested that Council allow him to <br />remove trees within PUD 87-25 in order that he can located his desired houses <br />on two lots and to relocate the Molinaro house onto a third lot, each of which <br />may require the removal of several trees. He advised that some of the walnut <br />trees should be removed in any case and replaced. <br /> <br /> Mayor Mercer stated the issue is whether or not this change would be a <br />major or minor modification to the PUD application. He stated if Council con- <br />siders it to be a major modification it goes back to Planning Commission; if <br />it is considered to be a minor modification it can be appealed by any Planning <br />Commissioner or Councilmember. <br /> <br /> Mr. Romero stated he is asking for a minor modification. He advised he <br />called the Planning Commission and invited them to this meeting to hear the <br />arguments presented tonight. <br /> <br /> Mr. Bob Molinaro stated staff indicated he could move his house onto his <br />lot within PUD-87-25, so he contracted for moving of the house; it is on jacks <br />now ready to be relocated. He felt he should be allowed to move his house at <br />this time. <br /> <br /> Mr. Swift stated he met with Messrs. Romero and Molinaro two weeks ago to <br />discuss the removal and replacement of two walnut trees so that Mr. Molinaro <br />could move his house onto the lot. He thought maybe this lot {Lot 1} could be <br />handled separately from Lots 3 and 4, and indicated that he would make a deci- <br />sion on this matter the following week.
