411 <br /> <br /> Councilmember Brandes asked how enforceable is Option B. Mr. Johansen of <br />the Police Department, stated Option B is enforceable; probably there would be <br />a warning citation given initially, then it would go to an infraction. <br /> <br /> Mayor Mercer stated the residents should be considered over leaf blowers. <br />He favored restricting operation of the leaf blowers between the hours of <br />10:00 p.m. - 6:00 a.m., Monday through Friday, and 10:00 p.m. - 7:30 a.m., on <br />Saturdays, Sundays, and holidays. <br /> <br /> After further discussion, it was moved by Councilmember Butler, and secon- <br />ded by Councilmember Brandes, that Ordinance No. 1356, to be read by title <br />only and waiving further reading thereof, amending the noise ordinance PMC <br />9.04.094, for total prohibition of leaf blowers from 10:00 p.m. to 6:00 a.m. <br />Monday through Friday, and from 10:00 p.m. to 7:00 a.m. on Saturdays, Sundays, <br />and holidays, with use of leaf blowers restricted to PB 4500 or equivalent <br />from 6:00 a.m. to 8:00 a.m. on Monday through Friday and 7:00 a.m. to 8:00 <br />a.m. on Saturdays, Sundays and holidays, be reintroduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brndes, Butler, and Mohr <br />NOES: Mayor Mercer <br />ABSNT: Councilmember Wilson <br /> <br />item lob <br />Adoption of Ordinance No. 1362, Approval of RZ-88-4~ Application of the City <br />of Pleasanton to amend the Municipal Code to allow the placement of real es- <br />tate open house directional signs within a public right-of-way <br />(Intro. 5-17-88~ 3-Ayes~ 1-No~ 1-Abstained) <br /> Mayor Mercer stated that Ordinance No. 1362 was introduced May 17, 1988, <br />by a vote of 3-Ayes, 1-No, and 1-Abstention, and that it was now in order to <br />adopt the ordinance. <br /> <br /> Councilmember mohr stated she would again abstain on this item as a matter <br />of principle because she is a realtor. <br /> <br /> Mr. Jack Hovingh, 4250 Muirwood, stated he is opposed to this ordinance <br />because of the visual impact it creates; there is no limit on a corner of the <br />number of signs that can be placed. He stated there is also the legalistic <br />view; it might provide a means for special interest groups to advertise and <br />promote events. He also failed to see the difference for a person trying to <br />sell his automobile from that of a person trying to sell his house. He is <br />concerned that over a period of time this exemption will result in that <br />through court rulings that the thing will be washed down so that there will be <br />no differentation between real estate signs and any other signs. <br /> <br /> Mayor Mercer stated this ordinance addresses real estate signs being <br />placed in medians; it gets the signs out of the medians and put on corners. <br /> <br /> Councilmember Brandes stated he voted against this ordinance because he <br />does not feel real estate signs are an attribute to the community. From a <br />business standpoint he did not think Council had the right to support the real <br />estate business. He did not feel it would be detrimental to the real estate <br />business not to allow the signs. <br /> <br /> Mayor Mercer stated the real estate signs provide a service to the com- <br />munity rather than to the realtor. <br /> <br /> - 10- 6-7-88 <br /> <br /> <br />
