413 <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember But- <br />ler, that Resolution No. 88-258, making application to LAFCO for Annexation <br />No. 100, a 6.2 acre parcel located on the west side of Foothill Road and owned <br />by Roger Picard; that Resolution No. 88-259, agreeing to the exchange of prop- <br />erty tax revenue for Annexation No. 100; and directing staff to notify the <br />applicant that he is required to prepare all the necessary documents and pay <br />all the required annexation fees, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wilson <br /> <br />MATTERS CONTINUED FOR DECISION <br />item lOa <br />Adoption of Ordinance No. 1356~ Amendment to the Noise Ordinance to Regulate <br />Leaf Blowers <br />(Intro. 3-15-88, 5-Ayes) <br />(Contd. from 4-5-88) <br />(Reintro. 5-17-88, 5-Ayes) <br /> Mr. MacDonald presented his report {SR 88:243) dated June 7, 1988, regard- <br />ing this matter. <br /> <br /> Ms. Elizabeth Kolar, Mission Park, stated she formerly lived near the <br />fairgrounds and when the leaf blower was used there during the Fair it was <br />impossible to sleep. Now she is concerned that there might be the same prob- <br />lem when the Raley*s store is opened in her area. She felt 5:00 a.m. was too <br />early to allow leaf blowers to operate; she also felt they should not be al- <br />lowed to operate earlier than 7:00-8:00 a.m. on weekends. <br /> <br /> Mr. Ron Berkheiser, 1893 Cortez Court, stated he felt leaf blowers should <br />not be allowed to operate on weekends and only from 6:00 a.m. to 10:00 p.m. <br />He stated there also might be a problem with enforcement on the type of leaf <br />blowers allowed. He reiterated his concern regarding noise levels, stating <br />that traffic is not a continuous noise while the leaf blower is a continuous <br />noise. <br /> <br /> Mr. Stan Zerodny, sweeper at the Amador Shopping Center, stated that if <br />this ordinance is passed with the restricted hours that his crews will have to <br />work split shifts, which creates a hardship. He stated that traffic and gar- <br />bage trucks create more noise than leaf blowers early in the morning. He ad- <br />vised that the new leaf blowers are quieter and he did not feel that noise <br />from them would adversely impact the neighbors. He stated he is willing to <br />start later on Saturdays and Sundays. He advised that the Amador Shopping <br />Center is very busy early in the mornings and it is difficult to property <br />maintain the grounds; he would like to begin his operations as early as <br />possible. <br /> <br /> Councilmember Butler stated he favors Option B - total prohibition of leaf <br />blowers from 10:00 p.m. to 5:00 a.m., with use restricted to PB 4500 or <br />equivalent leaf blowers from 5:00 a.m. to 8:00 a.m., with possible later hours <br />on weekends. <br /> <br /> - 9 - 6-7-88 <br /> <br /> <br />
