361 <br /> <br /> the people who are effected will get fair consideration of the impacts of the <br /> proposed plan. <br /> <br /> Mr. Ben Fernandez, Director Amador Valley Savings and Loan, stated that <br />the topograph issue is important but more important is the fact that Vintage <br />Hills residents have been assured that the dirt will not be hauled out through <br />their residential streets. He felt the proposed grading plan is a reasonable <br />solution for all concerned. <br /> <br /> Mr. Ken Starkridge, builder, stated he has just completed a house on lot <br />27 in Grey Fox Circle. He was aware at the time of purchase regarding the <br />grading plans of Mr. Beratlis. He stated he is pleased to be a part of the <br />Foxbrough development, and the City should be very proud of it; it will be a <br />good development. He feels the planning process has been followed. <br /> <br /> Mr. Beratlis stated he has tried to call Mr. King regarding this matter, <br />in fact he informed Mr. King about the public hearing. <br /> <br /> There being no further testimony, Councilmember Mohr declared the public <br />hearing closed on this item. <br /> <br /> Councilmember Brandes stated he has visited the site several times; he <br />feels that the grading and any development will not have an adverse effect on <br />Lot 1. He advised that development plans will be considered at a future time <br />and that all concerned residents will be notified. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Wilson, that Resolution No. 88-235, approving AP-88-9, and ap- <br />proving the grading plan of Amador Valley Savings and Loan (Chris Beratlis) <br />for Tract 5835 as submitted to staff, conditioned upon the staff and the ap- <br />plicant working with Mr. Hatsushi to maximize the amount of material placed on <br />the Hatsuski property to minimize that required to be placed on the Beratlis <br />parcel, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Wilson, and Chairperson Mohr <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Butler and Mayor Mercer <br /> <br />item 9b <br />RZ-88-04~ Application of the City of Pleasanton to amend the Municipal Code <br />relating to provisions for real estate and other related signs <br /> Mr. Swift presented his report (SR 88:216) dated May 10, 1988, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Jack Hovingh, 4250 Muirwood, spoke in opposition to the proposed or- <br />dinance; he felt it is poor law and creates special interest legislation, it <br />will detract from the beauty of Pleasanton, and is political in an election <br />year. He felt if the ordinance is enacted that the realtors should be charged <br />$250.00 for each sign and the money used to beautify the City, and that no <br />signs should be posted without front property ownerrs written permission. <br /> <br /> Mr. Frank Belecky, 892 Madeira Drive, stated he has spoken to several <br />realtors who are all in favor of the ordinance; he is in favor of it.
