363 <br /> <br />Road at the intersection of Zinfandel Court and Malaga Court <br /> Mr. MacDonald advised that the same Councilmembers would have to abstain <br />as did previously on discussion relative to this item, because of Conflict of <br />Interest and-the random selection of the previous meeting when this matter was <br />considered. Councilmember Butler and Mayor Mercer were required to abstain. <br />Councilmember Mohr Chaired this portion of the meeting. <br /> <br /> Mr. Swift presented his report {SR 88:224) dated May 17, 1988, regarding <br />this matter. <br /> <br /> Councilmember Mohr declared the public hearing open on this item. <br /> <br /> Mr. Chris Beratlis, representing Amador Valley Savings and Loan and him- <br />self, stated he concurs with the staff report. He advised that he has con- <br />tacted the owners of Lots 2, 4, and 5 and they are not opposed to the grading <br />plan. He stated that he has not been able to contact the owner of Lot 3, and <br />that he has tried to contact the owner of Lot I but has not been successful in <br />doing so. <br /> <br /> Mr. Darryl Alexander, 205 Main Street, presented drawings showing the <br />topography of the grading in relationship to the adjacent lots. He stated it <br />is proposed that some of the dirt would be dumped on the property of Mr. <br />Hatsushi and some on the property of Mr. Beratlis rather than haul it off <br />through City streets. <br /> <br /> Ms. Mary Frellin, 805 Grey Fox Circle, stated she owns the lot across from <br />Lot 1; her only opposition is that she does not know anything about what is <br />going on. She is concerned that development will destroy her view. She <br />stated that the owner of Lot 1, Mr. King, is opposed to the grading plan. <br /> <br /> Mr. Gary King, owner of Lot 1, stated his father bought this lot a year <br />ago and that house plans have been designed to take advantage of the view. He <br />is concerned that future development will obstruct his view. He stated the <br />staff report is not clear where the dirt will be dumped. He advised that he <br />has tried to contact Mr. Beratlis but that Mr. Beratlis did not return his <br />phone call. Mr. King felt that he did not receive proper notification of the <br />hearings regarding this matter; also residents living outside the 300 foot <br />required notification area who are most adversely affected were not notified. <br />He stated there are many unanswered questions and he is concerned about an <br />obstruction to the view from his residence. <br /> <br /> Mr. Alexander specifically reviewed Mr. King's lot in conjunction with the <br />grading plan, stating there will not be any significant impact on Lot 1. <br /> <br /> Mr. Jim Lavey, owner of Lot 5, stated he does not have any objection to <br />the proposal of moving the fill or to the proposed development. He stated the <br />type of housing proposed lends a nice variety to the housing needs in <br />Pleasanton. <br /> <br /> Mr. George Callaghan, owner of six lots, stated that he was aware of the <br />proposed development and grading plan when he bought his lots; Mr. Beratlis <br />informed him there would be a major land fill. He does not feel the grading <br />plan will be offensive to anyone. <br /> <br /> Ms. Beth McKnight, 824 Sylvaner, stated the homeowners in this area have <br />been very involved in this issue and they hope the City Council will see that <br /> <br /> 6 - 5-17-88 <br /> <br /> <br />
