399 <br /> <br />federal authority are technically exempt from the identification <br />portion of the law but they are required to be included in any <br />mitigation program. <br /> <br /> Councilmember Butler stated he felt it is important to get <br />this study finalized. He stated he would like to be sure as <br />Council finalizes the procedures that the question of historical <br />buildings is addressed and there be as much latitude as possible. <br />He stated that before Council gets to the point of mitigation <br />plans, he would like to see the Council give some direction to <br />staff as to the level of mitigation that Council is going to <br />require. As he understands the law there is quite a bit of <br />latitude that is given to local agencies in that regard; there is <br />no prescribed standard and it is important for Council to have <br />input to staff before getting to engineering plans. <br /> <br /> Councilmember Mohr stated the concerns she has in talking to <br />the people affected by this and reviewing the staff report have to <br />do with just what that mitigation is and on a historical building <br />it seems there would be no flat way that one could address what <br />those safety standards would be. What Council is looking at is <br />how to make the building safe; every building is going to be <br />unique when getting into the older structures. She did not know <br />how to come up with anything that is more than generic in saying <br />that they will be brought up to a level of safety. She asked if <br />there is a way to adopt a motion that would be loose enough to <br />give staff the flexibility to apply building by building or should <br />there being something to comply with the law that is specific to <br />the point that will make it difficult to apply. Mr. Roush stated <br />that at this point staff is probably not looking to that kind of <br />direction. Once staff gets the list compiled, it will bring back <br />a report so Council can see the scope of the problem and can <br />discuss generally the mitigation opportunities. At that point <br />Council can give some direction in terms of the level of detail <br />and type of mitigation Council is looking for. With that, staff <br />can develop a more thorough mitigation plan to bring back. <br /> <br /> Mayor Mercer asked if staff had been able to check with the <br />League of California Cities to see what other cities are doing to <br />address this problem. Mr. Roush stated he has obtained a number <br />of ordinances from a number of jurisdictions. Again, the <br />ordinances are all over the board. Some of them require complete <br />mitigation to meet code in 270 days; others have a five year <br />program. There is no grain of consistency in any of the <br />ordinances throughout the state. He stated that there is a lot of <br />flexibility with the governing body given the scope of the problem <br />and a realistic time frame. <br /> <br /> It was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, that Resolution No. 88-562, directing staff to <br />contract consultants about conducting a survey to identify <br />buildings affected by SB 547, and recommending the retention of a <br />consultant, be adopted <br /> <br /> - 6 - <br /> <br /> 12-6-88 <br /> <br /> <br />
