253 <br /> <br /> Councilmember Wilson asked whether donatioDs and gifts made <br />to the City would be the property of the City or Alameda County <br />Library. Mr. Roush advised that the agreement provides that the <br />County owns all books, etc., but the agreement could be amended to <br />show City ownership of any library materials which are donated to <br />the city. <br /> <br /> Councilmember Brandes stated that any gift could be consigned <br />to the Library by the City, with the City retaining ownership. <br /> <br /> Ms. Ginnie Cooper, Alameda County Librarian, stated that <br />donars could specify who they want to have ownership of the gift. <br /> <br /> Councilmember Brandes stated considerable effort of various <br />committees and agencies has gone into getting the library built; <br />he felt the meeting rooms should be for the community but that the <br />library should have first use of the room for their programs. <br /> <br /> Councilmember Butler stated he felt the City should be in <br />charge of the building since it is a City building but he would <br />respect the opinion of the Library Commission. <br /> <br /> Councilmember Wilson stated he feels strongly that the City <br />should maintain control of the library building. He stated the <br />City taxpayers paid for the library and it is only fair that the <br />City's Park and Recreation Department be given the opportunity to <br />make this work and in the spirit of cooperation he feels it can be <br />done. If it does not work out then it can be changed. He felt <br />the meeting room should be kept available for City use. <br /> <br /> Mayor Mercer stated that everyone has done an excellent job <br />in the building of the library. He felt the City should be in <br />control of the meeting room. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, to approve the Service Contract with Alameda <br />County Library System to operate the Pleasanton Library with the <br />Library to be in charge of the conference rooms. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes and Butler <br />NOES: Councilmember Wilson and Mayor Mercer <br />ABSENT: Councilmember Mohr <br /> <br /> Because of the tie vote, Mayor Mercer instructed staff to <br />place this item on the agenda of November 1, 1988, for full <br />Council attendance. <br /> <br />item 12b <br />Authorization for Staff to Enter into Negotiations with Foothill <br />Homeowners Association to Develop an Agreement for Improving <br />Foothill Knolls Park <br /> <br /> - 16 - <br /> <br /> 10-18-88 <br /> <br /> <br />
