249 <br /> <br />MATTERS CONTINUED FOR DECISION <br />item 10a <br />Adoption of Ordinance No. 1412, Approval of PUD-88-13, Application <br />of Bridqman Hunton, Inc., for development plan approval to <br />construct a 28 parcel sinqle-family residential project to be <br />located at 5137 Foothill Road <br /> Vice Mayor Butler stated that Ordinance No. 1412 was <br />introduced on April 4, 1989, by a vote of 4-Ayes, 1-No, and that <br />it is now in order to adopt the ordinance. <br /> <br /> Councilmember Tarver stated he did not see in the ordinance <br />the conditions added by Council at the last meeting, including <br />that lot 13 should not be changed so that there is not direct <br />access from Perry Lane to Foothill Road, that the project be <br />reduced by one lot on Palmdale Court, with a minimum 40 foot <br />sideyard set back on lots 23 and 29, and that any change to the <br />plan will come back to Council for consideration. <br /> <br /> Mr. Swift stated these conditions were inadvertently omitted <br />but that he would add them in the final ordinance. <br /> <br /> It was moved by Councilmember Mohr, and seconded by <br />Vice Mayor Butler, that Ordinance No. 1412 be adopted, approving <br />PUD-88-13, the application of Bridgman Hunton, Inc., for <br />development plan approval to construct a 28 parcel single-family <br />residential project to be located at 5137 Foothill Road. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Tarver, and Vice Mayor Butler <br />NOES: Councilmember Brandes <br />ABSENT: Mayor Mercer <br /> <br />item 10b <br />Adoption of Ordinance No. 1413, Amendinq the Growth Manaqement <br />Ordinance to extend the deadline for BridcFman Hunton, Inc., to <br />June 1, 1989 to apply for growth manaqement allocations <br /> (Intro. 4-4-89, 4-Ayes, 1-No) <br /> Vice Mayor Butler stated that Ordinance No. 1413 was <br />introduced on April 4, 1989, by a vote of 4-Ayes, 1-No, and that <br />it is now in order to adopt the ordinance. <br /> <br /> Councilmember Tarver asked if the language in this ordinance <br />would apply to any application approved prior to June 1, 1989. <br /> <br /> Mr. Roush stated that he made the ordinance generically <br />applicable to any project that would be applying for growth <br />management by June 1st, because at the time he wrote the ordinance <br />he did not know of any other projects that would fall into that <br />category; now there is a possibility of a project on Vineyard <br />Avenue being approved before June 1st. If that project is not to <br />be included, he will have to make the language in the ordinance <br />more restrictive. <br /> <br /> - 6 - 4-18-89 <br /> <br /> <br />
