There being no further testimony, Mayor Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmembr Tarver, that the project be reduced by one lot on <br />Palmdale Court and there be a minimum 40 foot side yard setback on <br />lots 23 and 29. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Tarver, and Mayor Mercer <br />NOES: Councilmember Butler <br />ABSENT: None <br /> <br /> It was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, that Resolution No. 89-173 be adopted, on the <br />basis of a review of an initial environmental study done for this <br />project and a finding that no significant environmental impact <br />would occur as outlined in the City's guidelines and a further <br />finding that a negative declaration is appropriate in connection <br />with PUD-88-13, the application of Bridgman Hunton, Inc., for <br />development plan approval to construct a 28 parcel single-family <br />residential project to be located at 5137 Foothill Road. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmembers Brandes and Tarver <br />ABSENT: None <br /> <br /> Councilmember Brandes stated he will be opposing the <br />application because he feels it is premature and that there could <br />be a better project for this location. <br /> <br /> It was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, after finding that the development plan is <br />consistent with the General Plan and with the purposes of the PUD <br />ordinance, that Ordinance No. 1412 be introduced, to be read by <br />title only and waiving further reading thereof, approving <br />Alternate Plan IIb of PUD-88-13, the application of Bridgman <br />Hunton, Inc., for development plan approval to construct a 28 <br />parcel single-family residential project to be located at 5137 <br />Foothill road, subject to conditions set forth in Staff Report <br />89:156, including a statement that lot 13 should not be changed so <br />that there is not direct access from Perry Lane to Foothill Road, <br />adding a condition regarding school impact fees, and a condition <br />that the project be reduced by one lot on Palmdale Court, with a <br />minimum 40 foot sideyard set back on the lots adjacent to <br />Hillcrest. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Tarver, and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes that the project not be <br />qualified for growth management allocation. <br /> <br /> - 14 - <br /> 4/o4/8 , S <br /> <br /> <br />
