PUBLIC HEARINGS <br />item 9a <br />RZ-89-3, Application of Joseph Madden to rezone an approximately <br />.24 acre site from PUD (Planned Unit Development)- <br />Industrial/Commercial and Offices District to the C-S (Service <br />Commercial) District located at the northern terminus of Old Santa <br />Rita Road between Tassa~ara Creek and Old Santa Rita Road <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 89:150) dated April 4, <br />1989, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the <br />application and the negative declaration. <br /> <br /> Mr. Joseph Madden, 1544 Santa Rita Road, stated he is in <br />agreement with the staff report, and appreciates the Planning <br />Commission's unanimous recommendation for approval. <br /> <br /> No one in the audience spoke in opposition to the item. <br /> <br /> There being no further testimony, Mayor Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Mohr, that Resolution No. 89-172 be adopted, on the <br />basis of a review of an initial environmental study done for this <br />project and a finding that that no significant environmental <br />impacts would occur as outlined in the City's guidelines and a <br />further finding that a negative declaration is appropriate in <br />connection with RZ-89-3, the application of Josephy Madden to <br />rezone an approximately .24 acre site from PUD (Planned Unit <br />Development)-Industrial/Commercial and Offices District to the C-S <br />(Service Commercial) District located at the northern terminus of <br />Old Santa Rita Road between Tassajara Creek and Old Santa Rita <br />Road. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Mohr, after finding that the proposed C-S (Service <br />Commercial) zoning district is consistent with the goals and <br />policies of the General Plan, that Ordinance No. 1411 be <br />introduced, to be read by title only and waiving further reading <br />thereof, approving RZ-89-3, the application of Joseph Madden to <br />rezone an approximately .24 acre site from PUD (Planned Unit <br />Development)-Industrial/Commercial and Offices District to the C-S <br />(Service Commercial) District located at the northern terminus of <br />Old Santa Rita Road between Tassajara Creek and Old Santa Rita <br />Road. <br /> <br /> - 11 - 4/04/8 s <br /> <br /> <br />
