389 <br /> <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Mohr, and seconded by <br />Councilmember Butler, to approve PUD-88-11, the application of <br />John Altieri, R. Marshall, and Ray Thompson for development plan <br />approval, subject to getting an agreement with the Fair Board; if <br />agreement cannot be reached in a timely fashion, then the project <br />can go forward with a lift station to be maintained by a <br />homeowners association; and if agreement cannot be reached <br />relative to the access road, then the project can go forward <br />without it. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler and Mohr <br />NOES: Councilmembers Brandes, Tarver, and Mayor Mercer <br />ABSENT; None <br /> <br /> After discussion, it was moved by Councilmember Tarver, and <br />seconded by Councilmember Butler, finding that the rezoning and <br />development plan are consistent with the General Plan and the <br />purposes of the PUD ordinance, to introduce Ordinance No. 1409, to <br />be read by title only and waiving further reading thereof, <br />approving PUD-88-11, the application of John Altieri, R. Marshall, <br />and Ray Thompson for Planned Unit Development rezoning and <br />development plan approval for a 21-parcel single-family <br />residential project to be located on an approximately 12.3 acre <br />site located generally in the area on the north side of the <br />western terminus of Rose Avenue, subject to conditions contained <br />in Staff Report 89:73. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, mohr, Tarver, and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: None <br /> <br />item 9f <br />AP-88-11, Appeal by the City Council of Planninq Commission action <br />approvinq application of Hacienda Business Park Owners <br />Association, UP-88-14, for a conditional use permit to operate a <br />park-and-ride lot facility to be located on a portion of an <br />approximately 2.3 acre site located at the southeast corner of the <br />intersection of Chabot Drive and Owens Drive. Zoninq for the <br />property is PUD ~Planned Unit Development)-Industrial/Commercial <br />and Offices District <br /> Mr. Swift presented his report (SR 89:132) dated March 21, <br />1989, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the item. <br /> <br /> Ms. Elaine DeMarcus, BART representative for District 5, <br />stated that bus service to Santa Rita jail will begin April 24th. <br />She reviewed the various bus routes and which agency would be <br />covering the lines.
