He did not feel the General <br />Plan should be changed at this time. <br /> <br /> Councilmember Butler stated this amendment would not really <br />be changing the capacity of the road. He favors any alternative <br />that would maintain the road and make it more safe. <br /> <br /> Mayor Mercer stated there can be growth outside the City <br />with or without the alignment; Mr. Harris could come back with a <br />project that would be growth. Mayor Mercer stated he does not <br />feel there will be increased speed with the proposed realignment <br />and does not know what a further environmental impact report would <br />address. <br /> <br /> It was moved by Councilmember Butler, and seconded by Mayor <br />Mercer, that the negative declaration is appropriate for GP-89-1, <br />the application of the City of Pleasanton to amend the Circulation <br />Element of the General Plan by realigning Vineyard Avenue at its <br />intersection with Clara Lane to a straighter configuration. <br />The roll call vote was as follows: <br />AYES: Councilmember Butler and Mayor Mercer <br />NOES: Councilmembers Brandes and Tarvet <br />ABSENT: None <br />ABSTAINED:Councilmember Mohr <br /> <br /> Because of the tie vote, the motion failed and no action was <br />taken on the negative declaration. <br /> <br /> Mr. Roush advised that because no action was taken on the <br />negative declaration, Council cannot take action on the General <br />Plan amendment. <br /> <br /> Mr. Swift advised that without the approval of GP-89-1, <br />Council cannot take any action on PUD-88-17, the application of <br />Country Investors and George Ward. He stated Council could direct <br />staff to prepare an Environmental Impact Report relative to this <br />matter or keep the present alignment as it is. <br /> <br /> Mr. Ward stated he has pertinent information that he had <br />intended to present under item 9b, but which he felt would have <br />bearing on this decision. Mayor Mercer advised him the public <br />hearing is closed. <br /> <br /> After discussion, it was moved by Councilmember Butler, and <br />seconded by Mayor Mercer, directing staff to prepare an <br />environmental impact report that would govern Alternatives 1, 2, <br />and 3 contained in Staff Report 89:138. <br />The roll call vote was as follows: <br /> <br /> - 12 - 3-21-89 <br /> <br /> <br />
