No one in the audience spoke in opposition to the item. <br /> <br /> There being no further testimony, Mayor Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that on the basis of a review of an initial <br />environmental study done for this project, that no significant <br />environmental impact would occur as outlined in the City's <br />guidelines and that a negative declaration is appropriate in <br />connection with PUD-89-2, the application of Chet Richards and <br />Jessie Pries for development plan approval to construct a twelve- <br />unit apartment complex to be locataed on an approximately 2.8 acre <br />site located at 1045 Division Street, Resolution No. 89-117 be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that Ordinance No. 1406, to be read by title <br />only and waiving further reading thereof, be introduced, approving <br />PUD-89-2, the application of Chet Richards and Jessie Pries for <br />development plan approval to construct a twelve-unit apartment <br />complex to be located on an approximately 2.8 acre site located at <br />1045 Division Street, subject to conditions contained in Staff <br />Report 89:90, and adding a condition as follows: "That <br />construction pursuant to a valid building permit shall commence <br />within one year. Failure to do so will result in the expiration <br />of the development plan". <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br />item 10a <br />Adoption of Ordinance No. 1398, Adoption of the Redevelopment Plan <br />for the Downtown Redevelopment Pro~ect <br />(Intro. 2-21-89, 3-Ayes, 2-Abstained) <br /> Mayor Mercer stated he would have to abstain on this items as <br />well as items 10b and 13a because he owns stock in Community First <br />National Bank. <br /> <br /> Councilmember Mohr stated she has stock in Amador Valley <br />Savings and Loan so also will not be ablt to particiate in these <br />items for the same reason as Mayor Mercer. <br /> <br /> Councilmember Butler stated he also has a conflict of <br />interest but because one Councilmember has to participate in order <br />to have a quorum, he was selected to participate. <br /> <br /> - 24 - 3-7-89 <br /> <br /> <br />
