247 <br /> <br /> on the basis of a review of an initial environmental study done <br /> for this project, that no significant environmental impact will <br /> occur as outlined in the City's guidelines and that a negative <br /> declaration is appropriate in connection with RZ-89-1, the <br /> application of the City of Pleasanton to prezone an approximately <br /> 5.9 acre site located on the west side of Foothill Road southwest <br /> of the intersection of Racoon hollow Court and Foothill Road to <br /> the PUD (Planned Unit Development)-Rural Density Residential <br /> District. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br /> Councilmember Butler, that Ordinance No. 1401, to be read by title <br /> only and waiving further reading thereof, approving RZ-89-1, the <br /> application of the City of Pleasanton to prezone an approximately <br /> 5.9 acre site located on the west side of Foothill Road southwest <br /> of the intersection of Racoon Hollow Court and Foothill Road to <br /> the PUD (Planned Unit Development)-Rural Density Residential <br /> District, be introduced. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br /> NOES: None <br />ABSENT: None <br /> <br /> item 9g <br />RZ-89-2, Application of the City of Pleasanton to prezone an <br />approximately 100 acre site located on both sides of Bernal Avenue <br />qenerally between Independence Drive and Anqela Street to the "A" <br />fAgricultural) District or to any other zoninq district consistent <br />with the General Plan <br /> <br />Consider Adoption of Neqative Declaration <br /> Mr. Swift presented his report (SR 89:70) dated February 21, <br />1989, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on the <br />application and the Negative Declaration. <br /> <br /> Mr. Woody Pereira, representing Shapell Industries, stated he <br />concurs with the staff report and conditions contained therein. <br /> <br /> Mr. Gene Pons, 832 Abbie Street, stated he supports the <br />prezoning to the Agricultural District. He stated it is his <br />understanding that the property is currently under the Williamson <br />Act and that it has nine years to go before expiring, and to hgve <br />the Williamson Act cancelled earlier requires the landowner to <br />request the removal. He recommended that the City Council <br />maintain this property in the Williamson Act for the remaining <br /> <br /> - 20 - 2-21-89 <br /> <br /> <br />
