471 <br /> <br /> Mr. Frank Belecky, 892 Madeira, stated he has observed the <br />house under construction and it is three feet higher than the tri- <br />level behind it. <br /> <br /> Mr. Watenmaker stated there is a landscape plan which <br />requires that fences be put in. He stated that the former fences <br />have been removed, roots left, gaping holes remain, and he felt <br />this matter should also be investigated. <br /> <br /> Mrs. Beth McKnight, Sylvaner Drive, stated it was her <br />understanding that the project would be built in two phases; Phase <br />I would include 50 houses on the eastern portion of the property, <br />Phase II would include the remaining 13 houses behind her home. <br />She advised that the first house to be constructed is behind her <br />residence, and there is another house adjacent to that one under <br />construction. She asked why this phase is being developed first. <br />Mr. Swift advised there are more than two houses under <br />construction, and that it was not designated that the project <br />would be built in phases I and II. <br /> <br /> Councilmember Tarver stated he remembers discussion at the <br />Planning Commission level that this development would be <br />constructed in phases. <br /> <br /> Mr. Watenmaker stated the City told the concerned residents <br />that those houses would not be built until all the improvements <br />were completed. <br /> <br /> Councilmember Brandes asked how the conditions of approval <br />can be enforced if the original builder has sold the lots to <br />various individuals. Mr. Roush advised that the property owner <br />must satisfy the conditions of approval. <br /> <br /> Mr. Rollins stated the residents signed a paper agreeing to <br />one story houses behind their homes. <br /> <br /> Mr. Belecky stated the people have been harmed; they were <br />assured the one story structures would not obstruct their view. <br />He stated another violation is the construction truck route; it <br />was his understanding the truck route would be down Vineyard and <br />through the Texeira property. He stated the trucks are using <br />Crellin Road instead. He felt construction should be stopped <br />until all conditions of approval are met. <br /> <br /> Mrs. Judy Davis, 827 Sylvaner Drive, stated the residents <br />were told in meetings with the developer that the houses on the <br />hill would be finished before houses next to their residences <br />would be built, and this is not the case; houses are being <br />constructed behind existing homes first. <br /> <br /> Mr. Watenmaker stated that the conditions of approval state <br />that hours of operation are from 8:00 a.m. to 8:00 p.m.; he <br />advised that work begins at 7:00 a.m. <br /> <br /> - 7 - 1-3-89 <br /> <br /> <br />
