473 <br /> <br />NOES: None <br />ABSENT: None <br /> <br />MEETING OPEN TO THE PUBLIC <br /> Mr. Howard Watenmaker, 812 Sylvaner Drive, addressed the <br />Council regarding what he felt were gross violations to the <br />conditions of approval for Amador Valley Savings and Loan project <br />in the Vintage Hills area. <br /> <br /> Mr. Watenmaker stated that residents in this area expressed <br />their concerns to Council when this development was first <br />considered; they met with Councilmember Brandes and City staff as <br />well as the developer, and thought that the concerns had been <br />mostly alleviated. He advised that one condition of approval was <br />that there would be only one story houses built behind the Vintage <br />Hills residents; one home is under construction behind his home <br />now that is a one story house but is 25 feet high. His home is a <br />tri-level home and is only 22 feet hight. He stated his view is <br />completely ruined. He presented pictures showing the height of <br />the house and the view from his yard for Council's information. <br />He urged action to correct these violations. <br /> <br /> Councilmember Brandes stated he was at the subject site on <br />three different occasions when there was controversy last year, <br />checking the site plans and height of houses as well as grading, <br />fill, fence lines, etc. He stated the house under construction is <br />completely contrary to Council's intent of a one story structure, <br />and is a breach of Council's understanding of the conditions of <br />approval. He asked what can be done at this point to stop <br />construction until the conditions can be reviewed and until it be <br />determined if the conditions are being complied with. <br /> <br /> Mayor Mercer asked if staff had approved plans for this lot <br />and issued a building permit. Mr. Swift advised that the plans <br />were approved by staff and a building permit issued. He stated <br />the owner, Mr. Beratlis, assured staff that the house was one <br />story. <br /> <br /> Mr. Roush stated that one of the difficulties is that a <br />building permit has been issued and unless it can be shown that <br />the building permit was issued in error, it is questionable if the <br />construction can be permanently halted. <br /> <br /> Councilmember Brandes asked if construction can be put on <br />hold until the conditions of approval can be researched to see if <br />the conditions are being complied with. Mr. Roush stated that a <br />stop work order could be issued until the conditions are reviewed. <br /> <br /> Mr. Rich Rollins, 830 Sylvaner Drive, stated that when the <br /> project was first being considered, Council suggested that the <br /> residents meet with the developer, which they did, to work out <br /> their concerns. He stated the conditions of approval protects the <br /> builder, not the residents; he feels this is wrong; they worked <br /> hard to preserve their rights. <br /> <br /> - 6 - 1-3-89 <br /> <br /> <br />
