is opposed to a drive through fast food restaurant but would <br />accept a 50's theme. <br /> <br /> Ms. Mohr reiterated her concerns about the landscaping and <br />there was discussion about the feasibility of sending the project <br />back to the newly appointed Design Review Board for review and <br />recommendations. <br /> <br /> It was moved by Councilmember Mohr, seconded by Councilmember <br />Butler, that Resolution No. 89-254 be adopted to return Case Z-89- <br />142, the Application of Spieker Partners for design review <br />approval to construct an additional 65,800 sq. ft. retail floor <br />area (Phase II within the 15.96 acre Rose Pavilion Shopping <br />Center) located in the northeast corner of the intersection of <br />Rosewood Drive and Santa Rita Road, back to the Design Review <br />Board for a new landscaping plan and if necessary to reduce the <br />size of the building to accommodate more trees. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> It was moved by Councilmember Brandes to uphold the appeal in <br />Case AP-89-4. There was no second. <br /> <br /> It was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, to deny the appeal by the City Council <br />(AP-89-4) and thus approve the conditional use permit (UP-89-21) <br />to operate a supermarket within a retail commercial complex (Rose <br />Pavilion Shopping Center). <br /> <br /> Councilmember Brandes moved to amend the motion to add a <br />condition regarding the Santa Rita/I-580 interchange. There was <br />no second. <br /> <br /> Mr. Brandes then stated that if the store's being open 24 <br />hours a day becomes a problem, the Council should be able to <br />review the project at a later time; he asked that the conditions <br />be amended to include that provision. This was accepted by <br />Council. <br /> <br /> Resolution No. 89-255 was adopted, denying the appeal by the <br />City Council (AP-89-4) of a decision of the Planning Commission, <br />and thus approving Case UP-89-21, the application of Spieker <br />Partners for a conditional use permit to operate a supermarket <br />within a retail commercial complex (Rose Pavilion Shopping Center) <br />to be located at the northeast corner of the intersection of <br />Rosewood Drive and Santa Rita Road, subject to the conditions in <br />the staff report with an additional condition that a review of the <br />operation may be held at a later time. <br /> <br /> 6-6-89 <br /> -13 - <br /> <br /> <br />
