Mr. Tarver questioned the timing and traffic level concerns.
Mr. Blake said construction was to start in September or October
with six months to completion and opening.

Mr. Mercer asked about the theater. Mr. Blake stated he is
negotiating the lease now. Phase III looks like Fall now, but the
worst case scenario is March or April to start, with an opening of
next summer.

Dan Torres, Nob Hill Foods, pointed out this store is similar
to Pak N Save in Dublin and we don't need another discount store.
He also indicated the reason the prices are so low is because it
is a non-union operation.
Laura DiDio, 1833 Rheem Court, expressed concern about the
store being open 24 hours, which may increase the crime rate.

Tony Rakocija, 3233 Monmouth, indicated support of the
project and requested a crosswalk across Rosewood Drive from the
existing area to the new area. Mr. Swift confirmed the developer
had agreed to this.

The following tenants of Rosewood Pavilion spoke in favor of
the project:
Lee Chapman, 4247 Rosewood #15
Marcus Fuh, 4211 Rosewood #6
Leslie Sulzberg, 4275 Rosewood #23
Bob Dickerson, 4275 Rosewood #26 Robert Helms, 4275 Rosewood

Mr. Bill Hohl, 1767 Peru Court, supported the project. He
expressed concern about traffic turning on Rosewood off Santa Rita
Road.

Jason Clute, 977 Benecia Avenue, Sunnyvale, owner of Cost
Less Market, indicated Cost Less is not a clone of Pak N Save.
There are three levels of supermarkets: Nob Hill on one end with
price and service, Pak N Save in the middle and Cost Less at the
other end. He also pointed out that Cost Less is a union
operation.

Councilmember Mohr expressed concern about the design of the
building. She wanted more trees in front and more glass.

There being no further testimony, Mayor Mercer declared the
public hearing closed on application Z-89-142.

Councilmember Brandes indicated this looks like a warehouse
and the design is inappropriate for the area. He feels the store
is a heavy traffic generator and needs a condition that no
construction start until completion of the Santa Rita/I-580
interchange. He is opposed to the drive through restaurant and
opposed to the store being open 24 hours a day.

Councilmember Tarver was concerned about the Santa Rita and
Hacienda interchanges. He agreed it needs more landscaping. He

6-6-89
-12 -
