Mayor Mercer declared the public hearing open on this
application.

Roger Hartley, 7020 Koll Center Parkway, appeared on behalf
of the applicant and reviewed the details of the proposal

Councilmember Tarver expressed concern about granting
approval of a building not ready to be built immediately and would
prefer a condition that they will build in a reasonable amount of
time. Mayor Mercer indicated office space is different than
residential. A 40,000 sq.ft. project takes time to market and it
is necessary to have an approved plan ahead of time.

Mr. Hartley concurred. He indicated they are in the process
of completing several projects at Koll Center, including Birch
Lakes. Having approval ahead of time makes it easier to market a
building.

It was moved by Councilmember Butler, seconded by
Councilmember Mohr, to adopt Resolution No. 89-252, approving
PUD-80-2-12D, Application of Bernal Avenue Associates for design
review approval to construct an approximately 40,000 square foot,
two-story office building to be located on an approximately 4.7
acre site located at the northwest corner of the intersection of
Koll Center Parkway and Valley Avenue, incorporating the
conditions of approval as listed in Exhibit "A" of Staff Report
89:258.
