159

There being no further testimony, Mayor Mercer declared the
public hearing closed.

Councilmember Brandes expressed concern about development of
a commercial retail center within the business park. The regional
shopping center was established at Stoneridge and that is the
preferred location for a center like this. Mr. Brandes was also
concerned about the parking, architectural design and signage.

Councilmember Butler liked the architecture, but did not
think this an appropriate use for the site. He was also concerned
about the excess of FAR.

It was moved by Councilmember Butler, and seconded by
Councilmember Brandes, to adopt Resolution No. 89-280, denying
PUD-85-8-4D, the application of Retail Property development
Company for design review approval to construct a two-building,
approximately 35,900 sq. ft. retail commercial complex on
approximately 3.2 acres located on the north side of Owens Drive
approximately 400 feet east of the intersection of Chabot Drive
and Owens Drive.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, and Tarver
NOES: Councilmember Mohr and Mayor Mercer
ABSENT: None
ABSTAIN: None

7. SPECIAL AND INFORMATION REPORTS
Item 7a
Minutes from Staff Traffic Committee Meeting of June 1, 1989
Mr. Elliott presented his report (IR 89:45) regarding this
matter. No action was required or taken by Council on the item.

Mr. Brandes requested the Traffic Committee to review
routing for the Fair traffic on Valley Avenue. He also indicated
the intersection at Valley and Santa Rita is confusing and needs
to be examined, perhaps making all easterly traffic proceed at one
time.

Mr. Butler requested the Traffic Committee to look at the
· right turn to Bernal Avenue east from Sunol Boulevard.

Item 7b
Actions Taken by the Board of Adjustment, Design Review Board, and
Planninq Commission at their meeting of June 14, 1989
Mr. Swift presented his report (IR 89:48) regarding this
item.

Mr. Brandes had a question on application V-89-9, Valdez, and
asked if the mitigations approved solved the problem. Mr. Swift
reviewed the situation and the actions of the Board of
Adjustment. Mr. Brandes appealed the decision on the condition
that if the neighbor agrees with the conditions then he withdraws
his appeal.

-9-

6-20-89
