147 <br /> <br />Item 6k <br />AP-89-8, Appeal of a decision of the Design Review Board of Case <br />Z-89.227, Application of Wade McClure/Walgreen's for desiqn review <br />approval for a comprehensive sign proqram for Walgreen's at 1763 <br />Santa Rita Road in Amador Plaza <br /> Mr. Swift presented his report (SR 89:329) regarding this <br />matter. <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> There being no testimony, Mr. Mercer declared the public <br />hearing closed. <br /> <br /> Mr. Brandes indicated that he agreed with the Design Review <br />Board and asked the staff if there were any mechanism in this <br />process about talking to the developer regarding the status of the <br />shopping center, e.g., major deterioration and cleanliness. He <br />also stated that if the application deals only with the sign, then <br />he would withdraw his appeal. <br /> <br /> Mr. Swift answered that the application dealt only with the <br />sign and added that the Design Review Board attached conditions <br />requiring the developer to repair the sidewalk around the outside <br />of the facility, replant street trees, redo the landscaping in the <br />project, and repave the parking lot in those portions where it is <br />breaking out. <br /> <br /> Mr. Brandes withdrew his appeal. <br /> <br /> Mr. Wade McClure thanked the Council for their action. <br /> <br />Item 61 <br />Resolution of Necessity - Eminent Domain Proceedinqs - Farmers <br />Insurance Property <br /> Mr. Roush presented his report (SR 89:292) regarding this <br />matter. <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application <br /> <br /> There being no testimony, Mr. Mercer declared the public <br />hearing closed. <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr, that <br />Resolution No. 89-321 be adopted, declaring the necessity to <br />acquire property by eminent domain. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> -15- <br /> <br /> <br />
