199

On Item B of New Business, Mr. Butler clarified that what he
wanted the staff to look into was the possibility of having the
righthand northbound lane on Sunol Blvd. to eastbound Bernal
Avenue be a right turn only without adding any additional lane,
since there is only one lane anyway on the north side of the
intersection.

Item 7b
Vintage Hills II Homeowners Association requesting information
about City plans regarding landscaping strip of land between the
sidewalk and south side of Crellin Road
Mr. Swift presented his report (IR 89:56) regarding the
matter.

It was moved by Mr. Butler, and seconded by Mr. Brandes, that
the Homeowners Association be informed that landscaping was their
responsibility.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

Item 7c
Actions Taken by the Design Review Board at its Meeting of
7-26-89
Mr. Swift presented his report (IR 89:59) regarding the
matter.

Regarding item Z-89-360, fFinch), Mr. Brandes inquired
whether the property is automatically approved with all its
problems, like parking, for instance, without coming back to
Council.

Mr. Swift replied that the Planning Commission approved a
conditional use permit for the restaurant. He added that the
parking codes for the downtown area have been changed so that now,
any use can go into any building downtown irrespective of whether
or not there is any parking area.

Mr. Brandes indicated that he wanted the conditional use
permit appealed and brought to Council.

Item 7d
Report of Closure of Daycare Center
Ms. Bengtson presented her report (IR 89:57) regarding the
matter.

Mr. Tarver inquired if there would be sufficient room in the
pre-school for all or would enrollment be on a first-come-first-
served basis.

-14 -
8-1-89
