Mr. Butler expressed some concern about the potential for the <br />City to be involved in the condemnation of a property. He added <br />that he found it very appropriate that conditions were placed on <br />the project regarding greater setbacks, a smaller FAR ratio and <br />Recommendation No. 11, which indicates that the City always has <br />the option to decide on the condemnation issue at some time in the <br />future. <br /> <br /> Ms. Mohr commented that she also had serious reservations <br />regarding the condemnation matter. <br /> <br /> Mr. Mercer concurred with Mr. Butler's and Ms. Mohr's <br />comments. He stated that he would support the project under the <br />condition that the concerns brought up by Mrs. Ku., Mr. Kliment <br />and the Mollers are addressed and satisfied. <br /> <br /> Mr. Tarver expressed agreement with the statements made. He <br />added that something should be put together for the development <br />along Foothill Road rather than deal with it in a piecemeal <br />manner. <br /> <br /> It was then moved by Mr. Butler, and seconded by Ms. Mohr, <br />that Ordinance No. 1442 be introduced, to be read by title only <br />and waiving further reading thereof, approving'PUD-88-16, the <br />application of Fred Hempy for development plan approval to create <br />a four-parcel, single-family residential project to be located on <br />an approximately four acre site located at 5226 Foothill Road, <br />subject to the conditions recommended by staff. <br />The roll call vote was as follows: <br />AYES: Councilmember Butler, Mohr, Tarver and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Item 6d <br />RZ-89-14, Application of the City of Pleasanton to Amend the <br />Pleasanton Municipal Code to Conditionally Allow the Temporary <br />Sales of Christmas Trees in the Multi-Family Residential and Other <br />Zoning Districts <br /> <br /> Mr. Swift presented his report (SR 89:494) regarding the <br />matter <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> There being no testimony, Mr. Mercer declared the public <br />hearing closed. <br /> <br /> -11- <br /> 11-21-89 <br /> <br /> <br />
