Mr. Swift pointed out that staff recommended that the <br />setbacks be doubled so that the closest the houses are to each <br />other would be forty feet. The Floor Area Ratio (FAR) has also <br />been made to include the garage with a limit of 25% in contrast to <br />the existing 30% requirement which excludes the garage. The house <br />on Lot 2, being the closest to Foothill Road, has a height <br />restriction of no more than 25 ft. from the lowest part of the <br />foundation to the highest part of the roof. <br /> <br /> Mr. Cooper emphasized that the plan presents only the street <br />construction and does not include any grading, which will come <br />before the Design Review Board at a later time. He added that <br />there will be an adjustment made to the alignment of the upper end <br />of the private street as it enters Mrs. Ku's property. This will <br />be worked out with Mrs. Ku prior to the submission of the <br />tentative map. <br /> <br /> Mr. Darryl Alexander, Alexander and Associates, representing <br />Mr. and Mrs. Moller and Mrs. Ku, indicated that both the Mollers <br />and Mrs. Ku are aware of the roadway alignment plan and that they <br />are willing to cooperate given Mr. Swift's assurance that things <br />would be worked out with them prior to the submission of the <br />tentative map. <br /> <br /> Mr. Mike Kliment, property owner south of Mr. Hempy's <br />property, commended the staff report. He requested Council to <br />focus not just on Mr. Hempy's property but on the overall picture. <br />He emphasized his concern to preserve the country character of the <br />area and keep the impact of the road to the minimum. He pointed <br />out that if the driveways were removed, there would be no need for <br />turn lanes and the median would be reduced. He indicated that he <br />was ready to close his driveway if the road access would be <br />available. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr, that <br />Resolution No. 89-486 be adopted, based on a review of an initial <br />environmental study done for this project and on a finding that no <br />significant environmental impact would occur as outlined in the <br />City's guidelines and on a further finding that a negative <br />declaration is appropriate in connection with PUD-88-16, the <br />application of Fred Hempy for development plan approval to create <br />a four-parcel, single-family residential project to be located on <br />an approximately four acre site located at 5226 Foothill Road. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> -10- <br /> 11-21-89 <br /> <br /> <br />
