377 <br /> <br /> It was then moved by Mr. Butler, and seconded by Mr. Tarver, <br />that Resolution No. 89-425 be adopted, approving the Specific Plan <br />for a 293-acre site located south of 1-580, west of E1 Charro <br />Road, north of Trenery Drive, and east of the Gatewood <br />Apartments. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Tarver and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: None <br />ABSTAIN: None <br /> <br />11. REPORTS OF THE CITY MANAGER <br />Item 12a <br />ADDrOYal of Restaurant Sewer Connection Loan in the Downtown Area <br /> <br /> Mr. Smith presented his report (SR 89:427) regarding the <br />matter. <br /> <br /> Mr. Ray Bartolomucci, 1376 East 14th Street, San Leandro, <br />owner of Strizzi's Restaurant, stated that he had been working <br />with the Design Review Board for the past three months and that he <br />has requested a loan from the City to help start his business in <br />the downtown area. <br /> <br /> Mr. Brandes asked the staff if the loan would be secured. <br /> <br /> Mr. Roush replied that the note would not be secured. It <br />would be a Promissory Note where the owner promises to pay the <br />loan over a period of time. If the person defaulted, the City <br />would try to collect against the borrower. <br /> <br /> Mr. Brandes stated that he supports the project but would not <br />want the City to have collection problems in the future. He added <br />that he would like to see the loan secured in some way. <br /> <br /> Mr. Roush suggested that the note could be secured with a <br />Deed of Trust against the property; however, the City must get the <br />property owner to enter into the Promissory Note under those <br />circumstances. <br /> <br /> Mr. Mercer inquired if the sewer capacity would be forfeited <br />to the City if the loan is not paid off. <br /> <br /> Mr. Roush replied that that was an option that could be made <br />a condition of the loan. If the loan is not paid, all sewer <br />capacity that went to the property would be forfeited. <br /> <br /> Mr. Brandes asked if the project needed to come before the <br />Ccunci! for approval. <br /> <br /> -11- <br /> 10-3-89 <br /> <br /> <br />
