MATTERS INITIATED BY COUNCILMEMBERS <br />Item 8a <br />Residential Chimney Spark Arrestors <br /> <br /> Mr. Hill presented his report (IR 89:64) regarding the <br />matter. <br /> <br /> Mr. Brandes inquired how well the installation of chimney <br />spark arrestors has been monitored considering the conditions <br />under which this had to be done, and if this could be made <br />mandatory. <br /> <br /> Mr. Walker replied that the Building Department is enforcing <br />this for every building permit issued where building costs would <br />exceed $1,000. He added that the City does not have as much <br />control over resales, but he would check on that. <br /> <br /> Mr. Butler commented that the key to enforcement would be to <br />assure that all local contractors are aware of this requirement. <br /> <br /> Mr. Hill stated that when the spark arrestor ordinance was <br />adopted in 1987, the City Attorney sent a memorandum to all real <br />estate brokers and agents and title companies doing business in <br />the Alameda County, specifically in Pleasanton. According to the <br />ordinance, it is the responsibility of the realtors to assure that <br />upon resale of a house, there is a spark arrestor in place. Any <br />re-roofing job that would cost more than $1,000 would likewise <br />require a spark arrestor. <br /> <br /> Mr. Butler asked Mr. Hill if he knew how many of the 10,000 <br />older dwellings have been retrofitted since the ordinance went <br />into effect. <br /> <br /> Mr. Hill replied that he did not and that it could not even <br />be determined how many of the 9,000 developers originally <br />considered in 1987 actually had fireplaces. <br /> <br /> Mr. Mercer inquired how the City would know if a realtor does <br />not inform a buyer of a house with no spark arrestor of the <br />requirement that a spark arrestor is to be put in place. <br /> <br /> -9- <br /> <br /> 9-19-89 <br /> <br /> <br />
