179 <br /> <br />to vote in favor of proceeding with the environmental work which <br />would more fully describe the effects of this additional route. <br /> <br /> Mr. Mercer explained that EBDA is a dischargers agency <br />composed of five cities on the other side of the hill. He <br />stated that when the TWA proposal was being put together, EBDA <br />could not get the five cities interested in discussing the <br />possibility of the project because the East Bay Municipal Utility <br />District (EBMUD) was actively trying to be the project of choice. <br />Subsequent to EBMUD starting their project and TWA ending in <br />Court, EBDA agreed to work with TWA regarding the possibility of a <br />project. One of the requests is to have a certified EIR, which is <br />in the process of being redone. But the City of Livermore came <br />back and wanted a study on a no-growth alternative, which has <br />already been studied and certified by the judge. All the TWA <br />members agree that additional work on an environmental alternative <br />needs to be done; the basic point of disagreement is Livermore's <br />no-project/smaller-project alternative. <br /> <br /> Mr. Brandes inquired if the additional study would incur <br />another $100,000. <br /> <br /> Mr. Butler replied that the supplemental EIR work would cost <br />$100,000, a small fraction of which would go to one of the six <br />alternatives. <br /> <br /> Mr. Brandes stated that a commitment from EBDA would be <br />necessary if the pipeline and the EIR show that certain things <br />needed mitigation. <br /> <br /> Mr. Mercer stated that there is the commitment to negotiate. <br />One of the commitments EBDA requested is to have a certified EIR. <br />There may not be any guarantee from EBDA, but it would be worth <br />studying the alternative. <br /> <br /> Mr. Brandes indicated that he would support this if it will <br />be all-encompassing and address everyone's concerns. <br /> <br /> It was moved by Mr. Mercer, and seconded by Mr. Brandes, to <br />approve directing Mr. Mercer and Mr. Butler, as members of the <br />Tri-Valley Wastewater Authority, to vote in favor of proceeding <br />with a supplemental environmental impact report to consider an <br />East Bay Discharge Authority alternative for sewage capacity <br />expansion. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> - 15 - <br /> 4-3-90 <br /> <br /> <br />
