This will
then go to the DRB for approval or revision.

Mr. Mercer stated that it was his understanding that it was
Council's decision whether the building should be moved or torn
down. He inquired why the matter should come before the DRB if
Council can decide to tear it down.

Mr. Roush replied that ultimately, this is the Council's
decision. The normal process would be for the DRB to consider the
plans before the Planning Commission and the City Council look at
the land use. However, the Council can look at the land use first
before consideration by the DRB, but the decision on the land use
is sometimes contingent on how the DRB decides.

Mr. Butler commented that this should be treated like any
other project. If the company applies for relocation, it should
go through the process like any other project.

Item 7c
Actions of the Zoninq Administrator, Design Review Board and
Planninq Commission at Their Meetings of March 13, 1990 and
March 14, 1990

Mr. Swift presented his report (IR 90:30) regarding the
matter.

Mr. Mercer stated that he received a phone call from the
applicant for PUD-80-15-5D-1M indicating that he would like to
have a sit-down restaurant instead of a fast food restaurant on
the site.

- 24 -
3-20-90
