131 <br /> <br />discussed with Ms. Ostle that bringihg her driveway onto the old <br />Foothill Road would require crossing the creek and going through <br />private property unless a little alley-way could be run alongside <br />the existing roadway, which presents a real problem to the Traffic <br />Engineering Department. He stated that staff will continue to <br />look at all the options possible as the project finalizes its <br />improvement plans. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> Mr. Brandes asked staff if the project included conditions <br />which would allow the City to come in and do maintenance work on <br />the common area. <br /> <br /> Mr. Swift said yes. <br /> <br /> Mr. Brandes stated that he voted against this project in the <br />original PUD not because it was not a good project but because he <br />found it premature. He indicated that the project has since gone <br />through the development process and completed growth management. <br />It has also changed the infrastructure and dealt with the <br />circumstances that relate to the School District. <br /> <br /> Mr. Tarver stated that he was initially worried about the <br />project, but staff has done a lot with the developer to work out <br />the details and address the issues on Foothill Road and Bernal <br />Avenue. He added that it was a good project. <br /> <br /> Mr. Mercer commented that the fact that the project was <br />approved forced the developer and the City to expedite matters, <br />including the issues with the School District and traffic. This <br />has eliminated some of the concerns about the project being <br />premature. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Butler, that <br />Ordinance No. 1458 be introduced, to be read by title only and <br />waiving further reading thereof, approving PUD-89-5-1D, the <br />application of the DeSilva Group for PUD development plan approval <br />to construct a 251 unit single-family residential project and <br />related improvements on an approximately 136 acre site located at <br />the northeast corner of the intersection of Bernal Avenue and <br />Foothill Road. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> - 23 - <br /> 3-20-90 <br /> <br /> <br />
