161 <br /> <br /> Mr. Butler commented that this was a valid concern since <br /> Council is interested in lowering the cost of houses that are <br /> being built. <br /> <br /> Mr. Mercer indicated that this item could be rescheduled for <br />the next meeting under Matters Initiated by Councilmembers so the <br />developer can be present to answer questions on the project. <br /> <br /> Mr. Brandes inquired if there is an agreement indicating that <br />the developers will pay for the growth management fees and the <br />litigation costs. <br /> <br /> Mr. Roush replied that the developers have agreed to pay the <br />growth management fees and the costs related to the litigation. <br />If they default, the City can stop inspecting the project until <br />the growth management fees are paid. This agreement under <br />consideration establishes when the payment will be made. <br /> <br /> Mr. Brandes commented that growth management fees should be <br />paid up front and that the developers have been notified in <br />September 1989 that these have to be paid. He asked Mr. Roush if <br />the City can stop the project until the fees are paid. <br /> <br /> Mr. Roush replied that that was an option. <br /> <br /> Mr. Mercer inquired if interest will be collected on these <br />fees and if so, if these will be paid also after the houses are <br />sold. <br /> <br /> It was moved by Mr. Brandes that the project be stopped until <br />all fees are paid in full. <br /> <br /> The motion died for lack of a second. <br /> <br /> It was moved by Mr. Tarver, and seconded by Mr. Brandes, that <br />the matter be brought back at the next City Council Meeting in <br />order that the developers may answer all concerns regarding the <br />project. <br />The roll call vote was as follOWS: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> - 21 - <br /> 3 -6-90 <br /> <br /> <br />
