162 <br /> <br /> 13, REPORTS OF THE CITY ATTORNEY <br /> <br /> Aure~ment Between the City and the Pleasanton Unified School <br /> DiStriCt Concernina Financina the Gymnasium at the pleasanton <br /> Middle School <br /> <br /> Mr. Roush presented his report (SR 90:95) regarding the <br /> matter. <br /> <br /> Mr. Robert Cordtz, 262 West Angela Street, indicated that he <br /> was opposed to the proposal that the City contribute 50% of <br /> whatever the cost over-runs of the Middle School gymnasiums <br /> construction would be. He indicated that the City has already <br /> guaranteed $2.6 Million, and the additional request is based on <br /> the idea that because of the October earthquake, the gymnasiums <br /> may need additional strengthening. He inquired if the gymnasiums <br /> would have been built as planned if the earthquake did not take <br /> place. <br /> <br /> Mr. Mercer stated that the City has committed $2.6 Million <br /> for the gymnasiums, which would benefit the City as much as the <br /> School District. He added that the City would not have been able <br /> to purchase the property and build the gymnasiums on its own for <br /> $2.6 Million and that this is a good bargain to meet the City's <br /> recreational needs. The students can use the gymnasiums during <br /> school hours, and the Recreation Department can run its programs <br /> at the end of the day. <br /> <br /> Mr. Brandes stated that this is not a matter of assisting the <br /> School District and that he agreed with Mr. Mercer that this would <br /> benefit the'City. He indicated that the citizens of Pleasanton <br /> would use the gymnasiums far more than the School District would. <br /> He added that he would prefer to pay an additional amount than <br /> have a cut back on the plans that have been intricately worked <br /> out. He said that he would have no problem with a cost over-run <br /> of ten percent. <br /> <br /> Mr. Tarver indicated that it is good for the State to come in <br /> and make sure that the gymnasiums are safe for the people who will <br /> be using them. Unfortunately, the State does not have the funding <br /> to help out. He stated that the City will have to help the School <br /> District if the City wants to get those facilities. <br /> <br /> Ms. Mohr asked staff it the City reviews the architectural <br /> plans after the State looks into them. <br /> <br /> Mr. Bocian replied that it is the standard practice. <br /> <br /> - 22 - <br /> 3 -6-90 <br /> <br /> <br />
