56 <br /> <br /> Butler commented that a restaurant that provides good service <br /> like Strizzi's is what the downtown area needs. He pointed out <br /> that the important issue here is that the entire activity of <br /> eating outdoors is projected to take place on public property. He <br /> added that he could not see how the City could provide real estate <br /> for an enterprise to extend its business. He indicated that he <br /> was not opposed to outdoor dining but to the utilization of the <br /> sidewalk. He mentioned that he could not support this project. <br /> <br /> It was moved by Mr. Mercer, and seconded by Mr. Tarver, to <br /> have the applicant go to the Design Review Board for approval of a <br /> final design which would come to Council for final approval, and <br /> to have the City Attorney provide a legal opinion regarding what <br /> is needed to allow Strizzi's Restaurant to operate its business <br /> with tables on the sidewalk. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Mohr, Tarver and Mayor Mercer <br /> NOES: Councilmembers Brandes and Butler <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 12c <br /> Draft Environmental Impact Report (DEIR) for the BART <br /> Dublin/Pleasanton Extension Project <br /> <br /> Mr. Swift presented his report (SR 90:37) regarding the <br /> matter. <br /> <br /> Ms. Erlene DeMarcus, Bay Area Rapid Transit (BART) Board <br /> Director, stated that BART's policy calls for a two-station <br /> extension. She said that a problem BART faces in this regard is <br /> that there are three proposed stations, with Castro Valley having <br /> one of them. Requesting a third station would set a precedent; <br /> moreover, there is no funding available for that. She mentioned <br /> that she is working on a non-traditional funding for this third <br /> station. In the meantime, however, a decision has to be made <br /> whether to put the second station at the East Dublin/Pleasanton <br /> station or the West Dublin/Pleasanton station. She asked Council <br /> what its preference would be. <br /> <br /> Mr. Brandes inquired if the BART Board has already voted to <br /> have the station in Castro Valley. <br /> <br /> Ms. DeMarcus stated that they still have to vote on it. A <br /> public hearing will be held on February 6th, and the Board will <br /> adopt the project on February 8th. She explained that Castro <br /> Valley adopted the site in 1982, that she has done a re-evaluation <br /> of the Castro Valley center records, and that the residents of <br /> Castro Valley are pressing the supervisors to support this <br /> project. <br /> <br /> -22- <br /> 1-16-90 <br /> <br /> <br />
