442

Mr. Swift replied that the street does not allow trucks over
three tons unless they are making deliveries.

There being no further testimony, Mr. Mercer declared the
public hearing closed.

Mr. Brandes commented that the "No Truck" sign should be
posted in a more obvious position.

It was moved by Mr. Butler, and seconded by Ms. Tarver, that
Resolution No. 90-160 be adopted, based on a review of an initial
environmental impact study done for this project and on a finding
that no significant environmental impact would occur as outlined in
the City's guidelines and on further finding that a negative
declaration is appropriate in connection with PUD-90-9, the
application of McDonald's Corporation to rezone an approximately
2.5 acre site from C-F and PUD-C and for development plan approval
to construct a new approximately 5,300 square foot, fast-food
restaurant with drive-through, located at 6800 Santa Rita Road in
the area generally bounded by Pimlico Drive and the new eastbound
entrance ramp from Santa Rita Road to 1-580.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

Mr. Butler expressed concern about the problem of truck
parking and other on-site traffic problems.

Mr. Roush stated that staff would like to amend the condition
regarding the certificate of occupancy to allow the applicant to
occupy the building prior to the installation of the landscaping on
the portion of the construction easement, with the understanding
that the landscaping would be done within two months after the
construction is completed.

It was then moved by Mr. Butler, and seconded by Ms. Mohr,
that Ordinance No. 1483 be introduced, to be read by title only and
waiving further reading thereof, approving PUD-90-9, the
application of McDonald's Corporation to rezone an approximately
2.5 acre site from C-F and PUD-C and for development plan approval
to construct a new approximately 5,300 square foot, fast-food
restaurant with drive-through, located at 6800 Santa Rita Road in
the area generally bounded by Pimlico Drive and the new eastbound
entrance ramp from Santa Rita Road to 1-580.

8-21-90
- 18 -
