304 <br /> <br /> Ms. Rossi replied that recently, staff visited the businesses <br />that had not paid their dues and made an effort to collect and <br />that only two business have outstanding dues for the year. She <br />added that the penalty for non payment is the same as that of the <br />business license: 5% of the fee per month with a maximum of 50%, <br />which is collected through small claims court. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> Mr. Mercer commented that the Council is put in an awkward <br />position when not all the business people agree. He suggested <br />that both sides come together and try to work something out to <br />make a better Downtown Association. He indicated that he would <br />support to continue the assessment. <br /> <br /> It was moved by Mr. Brandes, and seconded by Mr. Tarver, that <br />Resolution No. 90-116 be adopted, confirming the Downtown <br />Pleasanton Advisory Board report and levying the 1990-91 <br />Assessment. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br />Item 6h <br />1990-91 Annual Assessments for Landscape District 1984-1, <br />Ponderosa Homes <br /> <br /> Mr. Elliott presented his report (SR 90:241) regarding the <br />matter. <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> There being no testimony, Mr. Mercer declared the public <br />hearing closed. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, that <br />Resolution No. 90-117 be adopted, confirming the Engineer's Report <br />and levying the annual assessment, as set forth in the Staff <br />Report. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br />- 28 - <br /> <br />6-19-90 <br /> <br /> <br />
