298 <br /> <br /> Mr. Mercer stated that Wells Fargo will be a tremendous asset <br />to the community and commended Mr. Conroe and Mr. Nelson for a <br />good job. He indicated his support for the project. <br /> <br /> Ms. Mohr stated that she agreed with Mr. Mercer and pointed <br />out the City's expectations of the project in term of helping <br />volunteer community based organizations. She indicated her <br />support for the project and welcomed Wells Fargo to the <br />community. <br /> <br /> Mr. Tarver stated that Wells Fargo is the type of development <br />that Pleasanton needs and that it would be an asset to the <br />community. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, that <br />Ordinance No. 1472 be introduced, to be read by title only and <br />waiving further reading thereof, approving AP-90-7, PUD-81-22-6M, <br />the application of Mozart Development Company and Wells Fargo Bank <br />for a major modification to an approved development plan and final <br />development plan approval for a 604,750 square foot five-building, <br />five-story office complex and ancillary uses, including a helipad <br />atop one building and a potential child care center on a 27.8 acre <br />site located easterly of Stoneridge Mall Road between Fabian Court <br />and Embarcadero Court, as set forth in the Staff Report and <br />subject to the condition that Condition No. 15 be amended to read: <br />"The final design of the 'parking court' will be reviewed and <br />approved by the Design Review Board in conjunction with its review <br />pursuant to Condition B-2." <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Tarver and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br /> Mr. Brandes inquired if the PUD can prevail should there be a <br />conflict between the Development Agreement and the PUD. <br /> <br /> Mr. Roush replied that the intent of the Development <br />Agreement is to incorporate the terms and conditions of the PUD. <br />He stated that it can be made express that that in case there is <br />any conflict between the two, the terms and conditions of the PUD <br />would prevail. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, that <br />Ordinance No. 1472 be introduced, to be read by title only, and <br />waiving further reading thereof, approving the Development <br />Agreement with Mozart Development Company and Wells Fargo Bank for <br />a major modification to an approved development plan and final <br />development plan approval for a 604,750 square foot five-building, <br />five-story office complex and ancillary uses, including a helipad <br />atop one building and a potential child care center on a 27.8 acre <br />site located easterly of Stoneridge Mall Road between Fabian Court <br />and Embarcadero Court. <br /> <br />- 22 - <br /> <br />6-19-90 <br /> <br /> <br />
