264 <br /> <br /> Mr. Michael O'Callaghan, 8 Grey Eagle Court, General <br /> Contractor, stated that he was responsible for the ultimate on- <br /> site construction implementation of construction procedures <br /> regarding the homes. He explained that grading will expose only <br /> the topsoil and the subsurface strata. The big exposure will be <br /> where the basement structures of the houses will be cut into the <br /> hill. Subdrains will be built at the base of these structures to <br /> intercept any water that may drain in the future. Subdrains will <br /> also be built perpendicular to any gravel strata encountered which <br /> may pass water at a future date. These subdrains will be <br /> connected to the appropriate storm drain systems down the street. <br /> <br /> Mr. Gordon requested Council to approve this project because <br /> it is a safe and improved development which would benefit the <br /> neighborhood and the community. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br /> public hearing closed. <br /> <br /> It was moved by Mr. Brandes, and seconded by Mr. Butler, that <br /> Resolution No. 90-98 be adopted, based on a review of an initial <br /> environmental impact study done for this project and on a finding <br /> that no significant environmental impact would occur as outlined <br /> in the City's guidelines and on a further finding that a negative <br /> declaration is appropriate in connection with AP-90-4, the appeal <br /> of a decision of the Planning Commission denying approval of Case <br /> PUD-90-2, the application of Michael Gordon for planned <br /> development rezoning and development plan approval for a five-lot <br /> residential PUD, including the development of four new single- <br /> family residences, on a hilly two-acre site containing one single- <br /> family residence located at 445 Kottinger Drive. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Butler, Mohr, Tarver and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Mr. Brandes recommended that Condition No. 15e [14e, as <br /> adopted] be expanded to include not only ground water but also <br /> water bearing strata and that the property lines go all the way to <br /> the street. <br /> <br /> Mr. Butler commented that his initial concern about the <br /> project regarding the layout of the homes and street access have <br /> been satisfactorily addressed. He added that the concern about <br /> the stability of the hill has likewise been addressed as <br /> thoroughly as possible at this time and that Condition No. 15e <br /> [14e, as adopted] would take care of whatever problems may develop <br /> during construction. <br /> <br /> - 10 - <br /> 6-5-90 <br /> <br /> <br />
