219 <br /> <br />expedite the approval of the restaurant with the Design Review <br />Board (DRB) and the Planning Commission as part of what was <br />approved under Initiative Measure X. <br /> <br /> Mr. Butler stated that Council does not control the staff's <br />schedule, but that staff would work with him as long as he meets <br />deadlines. <br /> <br /> Mr. Mercer explained that the process allows the DRB and <br />Planning Commission to act independently, and if some members are <br />not completely comfortable with the project, they may want to <br />postpone their decisions. He added that it would be difficult to <br />tell the DRB or the Planning Commission to get the matter to <br />Council by the June 5th meeting. <br /> <br /> Mr. Brandes asked staff if the application could come before <br />the Council on June 5th if it goes to the DRB on May 22nd and to <br />the Planning Commission on May 23rd. <br /> <br /> Mr. Swift replied that it normally takes two weeks for an <br />application to go from the DRB to the Planning Commission and <br />another three weeks to go to Council. A Staff Report which would <br />include the DRB recommendations would have to be prepared for the <br />Planning Commission, and this cannot be done with a one-day turn- <br />around. <br /> <br /> Mr. Brandes inquired if this PUD would still need to come to <br />Council after it is approved by the DRB and Planning Commission. <br /> <br /> Mr. Swift answered that the conditions of the PUD would have <br />to be approved by Council. <br /> <br /> Mr. Henry Hatton, 3963 Fairlands Drive, whose property is <br />directly adjacent to the Measure X area, indicated that sit-down <br />restaurants like Baker's Square are what he and his neighbors want <br />in the area. He added that big trucks continually park near the <br />intersection because of a fast-food snack bar in the area, and <br />suggested that a tow-away sign be installed to put a stop to <br />that. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Mr. Brandes, and seconded by Ms. Mohr, that <br />Ordinance No. 1461 be introduced, to be read by title only and <br />waiving further reading thereof, approving PUD-80-15-5D-1M, the <br />application of the City of Pleasanton for a major modification to <br />an approved planned unit development ("Measure X"; PUD-80-15-5D) <br />to clarify the status of "fast food" restaurants as a prohibited <br />use in Pleasant Village Center, a retail commercial development <br />located at the southeast corner of Santa Rita Road and Pimlico <br />Drive, as set forth in the Staff Report. <br /> <br /> - 7 - <br /> 5-1-90 <br /> <br /> <br />
