227

At this point, Ms. Becky Dennis, 848 Gray Fox Circle,
approached the podium and indicated that she would like to comment
on Item 4n of the Consent Calendar on the Status Report on
Beratlis - 10 Beratlis Place. She stated that she and her
neighbors have read the Staff Report and that they agree with the
Option 2 recommendation.

Mr. Mercer stated that Council voted for Option 2 and that
the project will go through the regular PUD process. He explained
that the conditions have been reworded to reflect what was
specifically discussed and agreed upon at the neighborhood
meetings.

Ms. Dennis stated that a neighbor, Ms. Hersh, said that she
understood that not only the lots on the east side of the property
but all the lots with a 25-foot setback would have no structures
on them. This is not reflected in the conditions. She added that
Mr. Alexander had indicated that when Lot 15 is regraded, the
slope bank would be eliminated, which would affect Ms. Erskine's
property line.

Mr. Mercer replied that it was his understanding that when
Lot 15 is regraded, Mr. Beratlis would build a new fence for Ms.
Hersh and deed the property to her.

Mr. Brandes stated that he would like to reopen the item and
make sure that nothing is assumed and that the conditions are
recorded as the neighbors understand them.

Ms. Dennis noted that the slope bank would be deeded over to
the neighbors on condition that the plan for the 15 lots is
approved. She inquired if that would be become void if, for some
reason, the Planning Commission or the City Council decide against
the 15 lots.

Mr. Mercer replied that it was his understanding that Mr.
Beratlis had agreed with the neighbors on what he will do and what
the neighbors are willing to accept.

It was moved by Mr. Brandes, and seconded by Ms. Mohr, to
reconsider Item 4n - Status Report on Beratlis - 10 Beratlis Place
at the May 15, 1990 Council meeting.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, Mohr and Mayor Mercer
NOES: None
ABSENT: Councilmember Tarver
ABSTAIN: None

10. MATTERS CONTINUED FOR DECISION

No matters continued for decision were presented at this
meeting.

- 15 -
5-1-90
