147 Mr. Roush replied that the Zoning Ordinance provides that when a use is found to be detrimental to public health, safety or welfare, the Planning Commission and the City Council have the right to review and/or revoke the use permit. He explained that the provision is included in the Conditions of Approval to put the applicant on notice of that portion of the Ordinance. Mr. Butler stated that if the Ordinance specifically referred to issues that would impact public health, safety or welfare, it would help to clarify the Condition if the same language were used. Mr. Roush indicated that that could be done. Mr. Butler commented that Council found problems with the two uses it reviewed for this corner property in the past and stated that he thinks the proposed project would work well on the site. It was moved by Mr. Butler, and seconded by Ms. Scribner, that Resolution No. 90-228 be adopted, approving PUD-80-16-8D, the application of PacTel Properties for design review approval to construct a 3,937 square foot single-story Bank of America Branch Office located at the northwest corner of the Hopyard Road/ Stoneridge Drive street intersection, as set forth in the Staff Report, provided that Condition No. 19 be amended to reflect the same language as the Zoning Ordinance provision on the review and/or revocation of the use permit.
