147 <br /> <br /> Mr. Roush replied that the Zoning Ordinance provides that when <br />a use is found to be detrimental to public health, safety or <br />welfare, the Planning Commission and the City Council have the <br />right to review and/or revoke the use permit. He explained that <br />the provision is included in the Conditions of Approval to put the <br />applicant on notice of that portion of the Ordinance. <br /> <br /> Mr. Butler stated that if the Ordinance specifically referred <br />to issues that would impact public health, safety or welfare, it <br />would help to clarify the Condition if the same language were used. <br /> <br /> Mr. Roush indicated that that could be done. <br /> <br /> Mr. Butler commented that Council found problems with the two <br />uses it reviewed for this corner property in the past and stated <br />that he thinks the proposed project would work well on the site. <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Scribner, that <br />Resolution No. 90-228 be adopted, approving PUD-80-16-8D, the <br />application of PacTel Properties for design review approval to <br />construct a 3,937 square foot single-story Bank of America Branch <br />Office located at the northwest corner of the Hopyard Road/ <br />Stoneridge Drive street intersection, as set forth in the Staff <br />Report, provided that Condition No. 19 be amended to reflect the <br />same language as the Zoning Ordinance provision on the review <br />and/or revocation of the use permit. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr and Scribner <br />NOES: Councilmember Tarver <br />ABSENT: None <br />ABSTAIN: Mayor Mercer <br /> <br />Item 6cl <br />RZ-90-8, Application of the City of Pleasanton to Amend the <br />Pleasanton Municipal Code Definitions, Parkinq Standards, and <br />Location Criteria for Full-, Self-, and Quick-Service Station, <br />Convenience M~rket, and Full-, Self-, and Drive-Throuqh Car Wash <br />Uses <br /> <br /> Mr. Swift presented his report (SR 90:483) regarding the <br />matter. <br /> <br /> Mr. Mercer declared the public hearing open on the <br />application. <br /> <br /> - 9 - <br /> 12-11-90 <br /> <br /> <br />
