146 <br /> <br /> It was moved by Mr. Butler, and seconded by Ms. Mohr, that <br /> Resolution No. 90-227 be adopted, approving PUD-81-30-51D, the <br /> application of John Dutra for design review approval to construct <br /> 2 two-story office buildings totaling 28,129 square feet in an area <br /> located at the southeast corner of the Stoneridge Drive/Chabot <br /> Drive street intersection, as set forth in the Staff Report. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr, Scribner and Mayor Mercer <br /> NOES: Councilmember Tarver <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> Item 6b <br /> PUD-80-16-SD, Application of PacTel Properties for Design Review <br /> Approval to Construct a 3,937 Square Foot Single-Story Bank of <br /> America Branch Office Located at the Northwest Comer of the <br /> Hopyard Road/Stoneridge Drive Street Intersection <br /> <br /> Mr. Swift presented his report (SR 90:486) regarding the <br /> matter. <br /> <br /> Mr. Mercer stated that although he has retired from Pacific <br /> Bell, which is owned by PacTel, he would abstain from the <br /> discussion on this application because he receives a pension from <br /> Pacific Bell. <br /> <br /> Ms. Mohr declared the public hearing open on the application. <br /> <br /> Mr. Peter Brandon, Project Manager for Bank of America's <br /> Corporate Real Estate, the tenant for the proposed building, <br /> expressed concern about Condition of Approval No. 19 regarding the <br /> possible revocation of the use permit for three reasons: (1) the <br /> Bank has to comply with certain restrictions when it closes; <br /> (2) the Bank has a responsibility towards its customers; and <br /> (3) the Bank will be entering into a lease obligation with PacTel. <br /> He stated that the grounds for a possible revocation of the use <br /> permit was very vague and requested that the Condition be deleted <br /> or modified. <br /> <br /> There being no further testimony, Ms. Mohr declared the public <br /> hearing closed. <br /> <br /> Ms. Mohr inquired how this Condition would be implemented if <br /> a circumstance that supported the revocation were brought to the <br /> City's attention. <br /> <br /> - 8 - <br /> 12-11-90 <br /> <br /> <br />
