168 <br /> <br /> Item 10b <br /> Ordinance No. 1491, Approvinq Case PUD-90-13, the Application of <br /> S & S Properties (Westbrook) for Rezoninq and for Development Plan <br /> Approval <br /> <br /> Ms. Scribner indicated that the project's concept of medium- <br /> priced housing was good but that the site was not right. She <br /> agreed with Mr. Butler's proposal at the last meeting that the <br /> matter be sent back to the Planning Commission for its comments and <br /> recommendations regarding the General Plan Amendment. <br /> <br /> Mr. Mercer inquired if Council would still vote on the second <br /> reading if the ordinance were sent back to the Planning Commission <br /> for reconsideration. <br /> <br /> Mr. Roush replied that it would depend on what the Planning <br /> Commission does. If the Commission substantially modifies what the <br /> Council had approved on the first reading, Council would have to <br /> decide either to approve the ordinance for second reading or <br /> reintroduce an ordinance approving a modified version of the <br /> development plan. <br /> <br /> Mr. Butler indicated that he was opposed to the project at the <br /> first reading because he wanted to see the Planning Commission's <br /> recommendation on the matter. However, since the PUD was approved <br /> on the first reading, nothing would be gained by sending the matter <br /> back to the Planning Commission and having it come back to the <br /> Council for another review. <br /> <br /> It was moved by Ms. Mohr, and seconded by Mr. Mercer, that <br /> Ordinance No. 1491 be adopted, approving Case PUD-90-13, the <br /> application of S & S Properties (Westbrook) for rezoning and for <br /> development plan approval. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mohr and Mayor Mercer <br /> NOES: Councilmembers Scribner and Tarver <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> - 30 - <br /> 12-11-90 <br /> <br /> <br />
